Este libro expone, en un contexto biográfico, el pensamiento político y jurídico de Jaime Guzmán. Los momentos más intensos de su vida intelectual se desarrollan en torno a cruciales circunstancias políticas: la reforma agraria de 1967, el gobierno de la Unidad Popular, el golpe militar de 1973 y la génesis de la Constitución de 1980. Inspirado en el carlismo español, Guzmán encabeza la oposición gremialista a los gobiernos de Frei y Allende, y promueve la idea de un pronunciamiento militar para crear una “nueva institucionalidad”. En septiembre de 1973, la junta militar adopta esta noción, destruye la Constitución de 1925 y encomienda a Guzmán la creación de una nueva. La herramienta fundamental que emplea para iniciar este proyecto es la noción de Poder Constituyente que toma de Carl Schmitt, el Kronjurist de Hitler. De Schmitt también obtiene la idea de excepción, mediante la cual intenta legitimar las violaciones a los derechos humanos. A la luz de una interpretación sui generis de la doctrina social de la Iglesia y la tradición conservadora chilena, Guzmán forja un régimen constitucional que incluye un Estado autoritario fuerte y una economía de mercado libre. En su visión de una democracia puramente instrumental, al servicio de una sociedad de mercado, se percibe también la influencia de Friedrich Hayek.
