El presente trabajo pretende exponer y reflexionar sobre una situación crítica, que se pone de manifiesto en el desarrollo de algunos procesos penales en Argentina, en los que el lapso de tiempo existente entre la comisión de los hechos y la sentencia firme, es extremadamente extenso. Este ensayo se focaliza en el problema de los procesos penales extensos como lo fueron la venta de armas argentinas a Ecuador y Croacia, la venta del predio de la Sociedad Rural, el contrato entre la Dirección General Impositiva y la empresa International Business Machines y otros casos, los que, como jurisprudencia, son orientadores sobre la forma existente para poner fin a este tipo de procesos penales y a reflexionar sobre el sentido de los procesos largamente extendidos en el tiempo. Se analizan los procesos penales relacionados con los hechos ocurridos en Argentina en la década del setenta porque, en determinados momentos, el Estado Nacional, en uso de sus facultades punitivas, decidió ejercer la persecución penal para luego interrumpirla o suspenderla, por medio de leyes e indultos. Transcurridos 30 años, decidió aplicar nuevamente el poder punitivo, en algunos casos hasta después de transcurridos 48 años. Durante el lapso donde no se ejerció la persecución penal, las víctimas siguieron reclamando justicia y los imputados continuaron desarrollando sus vidas ajustados a derecho y a disposición de los órganos del Estado. Repentinamente algo varió, pero ¿qué cambió? Lo que mutó fue el staff del Estado en sus tres órganos de poder, imbuido de sus intereses e ideologías diferentes, generando resoluciones jurídicas sesgadas conforme a las conveniencias políticas o personales del momento. Si el Estado hubiese cumplido en tiempo y forma con su deber de persecución penal, aun habiendo condenado a los imputados a las penas más gravosas, hoy en día, éstas estarían cumplidas y en algunos casos hasta dos veces, situación que pone en crisis la institución de la prescripción, consagrada en el artículo 62 del Código Penal, en un todo de acuerdo con el artículo 75, inciso 22 de la Constitución Nacional. En relación a las víctimas, en su gran mayoría murieron sin tener acceso a la justicia y solo fueron resarcidos económicamente sus derechohabientes o en algunos casos ellos mismos, a través de numerosas leyes de reparación. Lo cual no es suficiente. Por lo expuesto, en el presente trabajo se desarrolla la oportunidad en que ocurrieron los hechos, la insubsistencia de la acción penal a la luz de las dilaciones indebidas, la falta de acceso a la justicia, la ausencia de tutela legal efectiva por parte del Estado y la inexistencia de plazo razonable. Subsidiariamente se pretende analizar, la participación y responsabilidad de los tres poderes del Estado, poniendo énfasis en la actitud de los magistrados federales. Ensayar algunas ideas de solución y reflexionar sobre la relación del tiempo transcurrido entre el momento en que se conocen los hechos y hasta que la sentencia condenatoria queda firme, para finalizar con algunas conclusiones personales. El único responsable de esta injusticia o justicia tardía es el Estado, quien, a través de sus 3 órganos de poder, el Ejecutivo, Legislativo y Poder Judicial, en particular su Justicia Federal, con control de constitucionalidad y convencionalidad inclusive, avalaron con sus fallos, interrumpir los procesos penales y negar justicia a quienes la necesitaban y reclamaban. El responsable de esta crisis jurídica es el propio Estado.
