The rule of law represents the heart of constitutionalism. Public power can only be legitimately exercised if it is based on and complies with the law. The Constitution and its fundamental values – human dignity, freedom and equality – are the ultimate sources of orientation for the rule of law. Domestic rule of law is complemented by its external dimension, the duty to respect international law and, for EU member states, supranational law. For the World Jurist Association, the realization of the Rule of Law has been the central concern since its founding more than 60 years ago. Its biennial world congresses, which bring together leading figures from politics, the judiciary and academia under the presidency of Javier Cremades, focus on the universal importance of the rule of law, which experts from numerous countries discuss on the basis of current problem areas. At the 2021 World Law Congress in Barranquilla, Colombia, one central topic was the tension between combating pandemics and the rule of law. The contributions gathered here examine how this challenge was met in political-legal practice, and the role of constitutional jurisdiction in the process. This edition of the Inter-American Yearbook on Human Rights, like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion and protection of human rights. It begins with the composition of the Commission and Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions and reports by the Commission and historic correspondences and decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the Velásquez Rodríguez case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social and Cultural Rights, reproduced in Part Four. Also included, in its entirety, is a report on the human rights situation in Haiti, a report requested by the Organization of American States Permanent Council in Resolution 502. Prisioneros en el calabozo de las apariencias, a partir de ese instante pasan a pertenecer a otros. Víctimas de un trato hostil, pierden su nombre y su lengua; continúan siendo sujetos activos, pese a que su vida y su trabajo pertenecen a aquellos con quienes están condenados a vivir sin poder entablar relaciones humanas. El segundo momento corresponde al nacimiento de la escritura y comienza hacia finales del siglo XVIII cuando, a través de sus propias huellas, los Negros, estos seres-cooptados-por-otros, comienzan a articular un lenguaje propio y son capaces de reivindicarse como sujetos plenos en el mundo viviente. Marcado por innumerables revueltas de esclavos y la independencia de Haití en 1804, los combates por la abolición de la trata, las descolonizaciones africanas y las luchas por los derechos civiles en los Estados Unidos, este período se completa con el desmantelamiento del apartheid durante los años finales del siglo XX. The public authorities have not successfully resolved the management of the traumatic memory of the wars, dictatorships and massacres to which the European project was always intended to be a counterpoint. The conflict of memories and the public discourses about the past are latent on ideological, political and cultural levels. However, if in the past the conflict concerning memories tended to develop inside the borders of countries, it has now leapt into the European arena. This has also led to the confrontation and questioning of the great narratives established in the common memory, especially with countries of the East joining the European Union. Each community, group or nation maintains common memories that do not always fit in or converge with a general overall account. The origins of the UB Solidarity Foundation’s European Observatory on Memories lie in these debates, and through this book — which includes the contributions of specialists in multiple disciplines and the speeches that were given at the first international symposium, “Memory and Power: A Transnational Perspective” — it hopes to present some of the key challenges that this conflict of memories has in store for us in the present and in the future.
