Había dejado personas llenas de esperanza, abiertas al futuro, pero las encontró en medio de una lucha cotidiana, siempre presas del sistema torturador. Su influencia se había ido apaciguando con el tiempo pero las dejó marcadas con el sello del desasociego. La edición original de El ser y la tortura, publicada por Presses Universitaires de France (PUF), en 2014, ganó el Premio Le Monde a la investigación Universitaria.

La tortura parece una abominación de épocas pasadas. Se diría que hablar de ella nos hace retroceder a los tiempos oscuros de la Inquisición o nos refiere a la idea de una humanidad tosca e imperfecta. Sin embargo, la tortura vuelve a estar de plena actualidad. Tras los horrores de la Segunda Guerra Mundial, un sistema penal libre de tortura y tratos degradantes distinguiría las democracias de las dictaduras y los regímenes totalitarios. Pero lo cierto es que se ha tratado de un espejismo. No sólo las democracias no han abandonado la tortura —que han seguido practicando dentro y fuera de sus fronteras—, sino que, con la mayor naturalidad, tras el 11-S el debate sobre la licitud de la tortura ha quedado abierto. Y aumenta el número de partidarios de una tortura civilizada: ¿por qué no recurrir al interrogatorio exhaustivo, incluso a la tortura no letal, si con ello se salvan vidas inocentes? ¿Qué objeción cabría hacerle a la tortura si se le fijan unos límites y la opinión pública es tenida al corriente? Frente al pragmatismo de quienes reducen la tortura a la contabilidad de vidas en juego, hay que recordar que, desde siempre, la tortura forma parte del poder soberano que decide sobre la vida y la muerte a través de un biopoder que controla la vida para administrar el tormento: la tortura no es un medio para arrancarle información a quien se resiste a darla, ni tiene por finalidad el dar la muerte, sino hacerla experimentar en vida.

Entre las razones de su utilización, está el hecho de que la tortura, a su modo y pese a la ofensa de los más básicos derechos fundamentales, constituye en la praxis policial una especie de «técnica de investigación» considerada por algunos como dotada de cierto grado de «eficiencia» en la resolución de los crímenes y como fuente de réditos profesionales que favorecen la perpetuación de tal práctica. Intentaremos aportar nuevas informaciones a la discusión dirigiendo nuestra investigación a intentar comprender lo que lleva a los policías a practicarla, y por qué resulta tan difícil erradicarla. [EN] This work starts from the fact that torture is a common and frequent practice in brazilian Police units, and it will probably remain the same for a long time, independent of treaties and commitments related to human rights Brazil signs, This happens because brazilian society does not investigate properly nor the causes neither the effects of torture practice. Among the reasons used to justify its practice is the fact that torture is, besides offensive to basic human rights, is considered by police officers a kind of «investigation technique», endowed with a certain grade of «efficiency» in crime solving and as source of professional credit. Both reasons foster the continuity of the practice. We will try to offer new information about the discussion driving our investigation towards the comprehension of what brings police officers to use torture as an usual method and why is it so difficult to leave it behind.
