"El Derecho Civil y su par adjetivo, merecidamente reciben la justa denominación de 'derecho madre'. Ello, en tanto que históricamente fue la primera manifestación del derecho positivo. Verbigratia: Las Institutas de Justiniano del Derecho Romano o el Código de Napoleón de Francia. Y es precisamente a ello, que las demás ramas jurídicas, ya sean sustantivas, ya sean procesales, observan la sede civil como punto de partida. Lo que se aprecia de manera muy notoria, en sus disposiciones finales, cuando utilizan la regla de oro: 'En todo lo no dispuesto en el presente Código, rige lo establecido en el Código Civil, siempre y cuando resulte aplicable a naturaleza del presente cuerpo normativo'. Empero allende de lo referido, es de resaltar la utilidad del derecho civil ciertamente es respirable a cada momento de la cotidianidad. Confirmando con ello la naturaleza de derecho privado, al establecer normativamente las diversas relaciones entre las personas. Entonces, la quintaesencia de su aplicación y observancia, deviene de ineludible como saludable primer orden. Ello, al margen de la innegable relación existente entre el derecho Civil y Procesal con los Derechos Fundamentales. De conformidad a lo preconizado por el Estado Constitucional de Derecho. En ese sentido, la presente obra se encuentra desarrollada en esa línea vigente. Es debido a dicho protagonismo y compromiso jurídico, que llamó nuestra atención a efectos de trabajar conjuntamente una obra que comportase el desarrollo y estudio de las temáticas basilares y estructurales. Esto es, de primera y mayor usanza en la vida diaria del ciudadano, justiciable. Así entrando en materia, la presente entrega: 'Dilucidaciones de Derecho Procesal Civil', abraza plenamente nuestra empresa emprendida, como un modesto aporte a la Academia. Las mismas revisten un cariz netamente proposicional. Por otro lado, en razón a la temática basilar en forma y fondo, modestamente bien podrían constituirse en una suerte de Teoría Elemental del Proceso Civil Analítico Aplicativo. Así también, las breves pinceladas de la presente entrega se encuentran orientadas no solo a los actores del mundo del derecho civil, sino también, de cualquier rama del derecho, en razón a su puesta en práctica de manera necesaria común.
