The European Commission for Democracy through Law, or Venice Commission, is the Council of Europe's advisory body on constitutional matters. It gives legal opinions on the development and operation of democratic institutions and constitutional law. The Venice Commission's work is aimed at upholding the three underlying principles of Europe's constitutional heritage: democracy, human rights and the rule of law. Since its inception, the Venice Commission has been particularly active in the field of elections, the cornerstone of democracy. This book is a compilation of the main Venice Commission texts dealing in general terms with elections and referendums. First come the reference documents: the Code of Good Practice in Electoral Matters and the Code of Good Practice on Referendums. These are followed by a judicious selection of general studies on such fundamental topics as recurrent challenges and problematic issues in electoral law in Europe, election systems, the representation of national minorities on elected bodies - through the application of general rules and specific measures - and a comparison of the legal rules on referendums in European states. This book is intended not only for election specialists (members of electoral commissions, academics etc) but also for observers, politicians and, more generally, any member of the electorate.

Governments need rules, institutions, and processes to translate the will of the people into functioning democracies. Election laws are the rules that make that happen. Yet across the world various countries have crafted different rules regarding how elections are conducted, who gets to vote, who is allowed to run for office, what role political parties have, and what place money has in the financing of campaigns and candidates. The Routledge Handbook of Election Law is the first major cross-national comparative reference book surveying the electoral practices and law of the major and emerging democracies across the world. It brings together the leading international scholars on election law and democracy, examining specific issues, topics, or the regions of the world when it comes to rules, institutions, and processes regarding how they run their elections. The result is a rich volume of research furthering the legal and political science knowledge about democracies and the challenges they face. Scholars interested in election law and democracy, as well as election officials, will find the Routledge Handbook of Election Law an essential reference book.

This volume includes the reports presented at the seminar on "European standards of electoral law in contemporary constitutionalism" organised by the Venice Commission in co-operation with the Constitutional Court of the Republic of Bulgaria in Sofia (Bulgaria), on 28 and 29 May 2004. Electoral law and co-operation with constitutional courts and courts of equivalent jurisdiction have been two of the main areas of the activities of the Venice Commission since its creation in 1990. The reports cover such fundamental issues as the advantages and shortcomings of different electoral systems, the case law of higher national courts on electoral disputes, the participation of foreigners in the electoral process at the local level, the electoral rights of individuals having the citizenship of other European countries and the possible development of electoral law within the European Union.

"This book fills a gap in constitutional law by investigating the global trend towards substantive constitutional adjudication of electoral legislation. On what premises is this judicial scrutiny grounded, what can explain the trend, and with what consequences for representative democracy? Given the global reach, the combination of theoretical and practical approaches, and the comparative assessment provided, this work is of interest for academics in the field of law, political science and philosophy, and for policy-makers and judges in constitutional democracies across the continents"--

Ritual And Rhythm In Electoral Systems written by Graeme Orr and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-03-09 with Law categories.

’Why do we vote in schools?’ ’What is the social meaning of secret balloting?’ ’What is lost if we vote by mail or computers rather than on election day?’ ’What is the history and role of drinking and wagering in elections?’ ’How does the electoral cycle generate the theatre of election night and inaugurations?’ Elections are key public events - in a secular society the only real coming together of the social whole. Their rituals and rhythms run deep. Yet their conduct is invariably examined in instrumental ways, as if they were merely competitive games or liberal apparatus. Focusing on the political cultures and laws of the UK, the US and Australia, this book offers an historicised and generalised account of the intersection of electoral systems and the concepts of ritual, rhythm and the everyday, which form the basis of how we experience elections. As a novel contribution to the theory of the law of elections, this book will be of interest to researchers, students, administrators and policy makers in both politics and law.
