O livro busca examinar a racionalidade das ações reparatórias de danos concorrenciais, especialmente aqueles decorrentes de cartéis, sob a perspectiva da União Europeia, dos Estados Unidos da América e do Brasil. Para tanto, procurou-se estabelecer os elementos de sua formação, a exemplo do próprio conceito e sua classificação, de noções de cartéis e danos por eles causados, dos pressupostos de responsabilidade civil e da relação entre persecução pública e persecução privada, com ênfase para a sua inter-relação no campo do direito antitruste. Em seguida, fez-se uma análise comparativa entre o contexto de regras e incentivos para o ajuizamento das ARDCs nos EUA e na União Europeia, focando a racionalidade dessas ações em contraste com o sistema persecutório de cada um dos sistemas jurídicos adotados. Mais adiante, o olhar do autor se dirige à situação das ARDCs no Brasil sob um prisma teórico, abordando-se questões sempre atreladas ao tema, a exemplo de prescrição; compartilhamento de documentos relacionados às infrações de cartel; tese de pass on defence; instrução probatória e estrutura jurídica das ações coletivas no contexto brasileiro. Em complemento, o texto oferece ainda uma análise empírica a respeito das ações de reparação por danos de cartel, perpassando os entendimentos jurisprudenciais e buscando delinear se há algum ponto de discussão que possa ser considerado entrave ou incentivo para a consolidação das ARDCs no ordenamento jurídico como instrumento efetivo de responsabilização do infrator e como meio ancilar de prevenção a cartéis (prevenção geral e especial), em complemento à persecução pública promovida pelo CADE e por outros órgãos.

No último artigo da série, eu procurei mostrar o quanto a compreensão da dimensão política dos mercados nos confere, como diria Stiglitz, um misto de esperança e desespero. Esperança porque sabemos que o mercado é resultado de escolhas políticas e jurídicas e, sob essa perspectiva, pode também ser modificado por novas escolhas. Desespero porque sabemos como tais processos são difíceis e como, especificamente no caso do Direito Antitruste, há toda uma máquina política, informacional e científica, financiada pelas elites econômicas, para obstar tais mudanças a qualquer custo. Não obstante, entre o desespero e a esperança, eu sempre optei pela última. E, ao ter o livro que ora eu prefacio nas mãos, vendo tantas mulheres talentosas engajadas no enfrentamento dos temas mais importantes do Antitruste, tenho mais um motivo para manter o otimismo e reforçar a convicção de que a possibilidade de evolução existe, é concreta e há muita gente qualificada construindo os caminhos viáveis. Afinal, ao contrário dos Estados Unidos, não precisamos de reforma legislativa. Temos uma Constituição Federal e uma legislação antitruste que, se bem interpretadas e aplicadas, são suficientes para os avanços necessários. É com esse espírito de otimismo que eu convido os leitores a se debruçarem sobre os artigos que compõem a presente obra, parabenizando mais uma vez o WIA e todas as autoras por mais essa relevante contribuição não só para o Antitruste, mas também para as conquistas femininas.
