Einleitung Im europäischen Vergleich ist das Familienrecht "stark traditionsgeprägt in dem insgesamt recht unterschiedlichen Rechtssystem"(1). Durch das allgemeine Grundprinzip der "Demokratie in der Familie"(2), innerhalb der letzten Jahrzehnte wurde die Rechtsposition von Vater und Mutter von gesellschaftsspezifischen Unterschieden befreit. Die Rechte der Kinder gegenüber den Eltern wurden gestärkt. Im deutschen und im angelsächsischen Rechtskreis war und ist die Rechtsposition der Mutter stärker als die des Vaters. Im romanischen Rechtskreis muss ein nichteheliches Kind durch dem Vater und der Mutter anerkannt werden. Der Vater, hatte dann die stärkere Rechtsposition, "er hatte die volle elterliche Gewalt, die Mutter allenfalls die Personensorge für das Kind .Vom Vater bekam das Kind seinen Namen und seine Staatsangehörigkeit "(3) . Laut der europäischen Konvention 1975 über den rechtlichen Status nichtehelicher Kinder folgt die Mutterschaft automatisch nach dem Geburt (Art. 2). In Fällen, in denen die Vaterschaft geklärt ist, darf die elterliche Gewalt nicht automatisch dem Vater zugeordnet werden(Art. 7). Die Konvention wurde aber von Luxemburg von den romanischen Ländern nicht ratifiziert. Die Empfehlung über das elterliche Sorgerecht des Europarats von 1984 war jedoch, dass jede Entscheidung in erster Linie dem Kindeswohl entsprechen soll. Screening programmes involve the systematic offer of testing for populations or groups of apparently healthy people to identify individuals who may be at future risk of a particular medical condition or disease, with the aim of offering intervention to reduce their risk. For many years, screening was practised without debate, and without evidence, but in the 1960s serious challenges were raised about many of the screening procedures then being practised. Benefits and harms of screening must be measured in high quality trials, and the benefits of screening must be weighed alongside the negative side-effects. Concerns were raised about potential and actual harm arising when people without a health problem received dangerous and unnecessary investigations and treatments as a result of routine screening tests. Controversy raged, and it took some 50 years to achieve widespread recognition that evidence-based and quality assured programme delivery was essential, coupled with provision of balanced informed to enable informed choice for potential participants. Commercially motivated provision of poor quality and non-evidence based screening tests is increasing and screening remains a highly contested topic that has relevance in all health systems including for the general public and media. This book serves as a practical and comprehensive guide to all aspects of screening. Currently, families are being subjected to increasing public attention. Interest is focussing on their potential strengths and weaknesses in determining how well children do at school. Alongside such human-development oriented expectations, families are also becoming a focus of attention as a resource for human capital in times of economic crises and criticism of the welfare state. In many European countries, parents and children are at the forefront of the welfare state and socio-educational activities in current programs and policies. The current transformation processes in the welfare state are making the relationship between families and the state more dynamic in general, and they are structuring the discourses on the childrearing, education, and child care services in the fields of both public and private responsibility. The introduction of all-day schooling in Germany also has to be viewed in this context. This is gradually changing the traditional half-day structure of German schools and shifting the borders of public and private responsibility on the levels of education, child care, and childrearing institutions. The attention given to parental childrearing and educational responsibility within the context of current national and international debates clearly underlines the fact that issues in private life are increasingly entering the public discourse and becoming subject to attempts at socio-political control. This raises the assumption of an increasing politicization of parenthood in the (post) welfare state that is focusing more and more attention on the structural conditions of gainful employment and child care as well as on the current relations between the genders. This context particularly emphasizes the time and care regimes that decisively determine the practices in daily family life and the utilization of all-day education settings.
