The Community strategy on heath and safety at work 2002-2006 called on the European Agency for Safety and Health at Work to set up a risk observatory to anticipate new and emerging risks. The production and use of chemical substances can have negative impacts on the environment. To avoid and/or limit these negative impacts the EU has adopted a large body of rules and implementing measures regulating chemical substances, their use, and their release into the environment. The REACH Regulation is the cornerstone of this acquis, inter alia, with a wide array of sectoral and compartmental EU environmental legislation on water, waste, air pollution, industrial emissions, and specific chemical products (e.g., biocidal and plant protection products). Despite this comprehensive and advanced EU acquis on chemical matters there is a growing concern among the scientific community that this acquis lacks the relevant mechanisms to adequately address emerging chemical risks to the environment in a timely manner. There are numerous examples of the long-time span between early signal and the adoption of adequate measures to address emerging risks as described in the EEA report "Late lessons early warnings report". The difficulty to get emerging chemical risks such as nanomaterials, PFAS and endocrine disruptors, on the radar of policy makers and governmental risk assessors exemplify the need for an EU-wide early warning and action system. As highlighted by the Council of the EU in its conclusions of the 2019 chemicals strategy, the identification of new, emerging risks constitutes a major challenge to tackle. Indeed, while ensuring the prevention of existing risks, it is also essential to be able to anticipate as soon as possible unforeseen consequences related to the use of chemicals and their release into the environment and to ensure that these emerging risks are properly addressed in a timely manner by EU policy and decision makers. Early warning systems (EWSs) thus appear to be relevant instruments to complement/support the implementation of the EU legislation on chemical matters by adopting a proactive and systematic approach to the identification of emerging risks, while fostering cooperation and knowledge-sharing among countries and scientific communities and improving the science and policy interface on such risks. Several initiatives on EWS have been developed in the EU such as the emerging risks exchange network (EREN) which is the EFSA EWS related to food and food safety and covering emerging chemical risks for human health and biodiversity). There is however no official systematic, permanent, and coordinated early warning system in place at EU level focusing on emerging chemical risks to the environment. This is considered in the new Commission Chemical Strategy for Sustainability Towards a Toxic-Free Environment3 which mentions that the 'Commission will develop an EU early warning and action system for chemicals to ensure that EU policies address emerging chemical risks as soon as identified by monitoring and research'. As part of the implementation of the Chemicals Strategy, the Commission has also set up an expert group on 'One substance, one assessment' with Commission services, Member States and EU Agencies to improve efficiency, effectiveness, coherence and transparency of the delivery of safety assessments of chemicals across legislation. Amongst its different tasks, the group shall also monitor, discuss and exchange views on early warning signals on chemicals within the framework of the early warning and action system on chemicals announced under the Chemicals Strategy.
