Consumption is one of the most influential, albeit dynamic, economic factors of the 21st century and, therefore, the legal rules and norms governing consumers are radically changing overtime. On European level, Directive 1999/44/EC has had a significant impact on the legal systems of member states, since its regulatory framework conflicts with well-established traditions rooted in the legal history of a country. This book will explore how and where the directive’s norms clash with national law; Germany and England and Wales will serve as examples of two opposite approaches towards its implementation. The book analyses the difficulties the International Criminal Court faces with the definition of those persons who are eligible for participating in the proceedings. Establishing justice for victims is one of the most important aims of the court. It therefore created a unique system of victim participation. Since its first trial the court struggles to live up to the expectancies its statute has generated. The book offers a new approach of how to define victimhood by looking at the different international crimes. It seeks to offer guidance for the right to participate in the different stages of the proceedings by looking at the practice in national jurisdictions. Lastly the book offers insights into the functioning of the reparation regime at the ICC by virtue of the Trust Fund for Victim and its different mandates. The critical analysis of the ICC-practice with regard to definition, participation and reparation aims at promoting a realistic approach, which will avoid the disappointing of expectations and thus help to enhance the acceptance of the ICC.

Voordeelsafgifte is een relatief onbekende rechtsfiguur in het Nederlandse privaatrecht. In diverse andere landen is er veel literatuur en rechtspraak over voordeelsafgihe. Dit geldt met name voor Duitsland. De Duitse literatuur en rechtspraak worden in deel 1 van deze studie beschreven en geanalyseerd. In deel 2 wordt aandacht besteed aan het Nederlandse recht. Daarbij wordt soms ook verwezen naar ontwikkelingen in Zwitserland, Engeland, Frankrijk en de Verenigde Staten. In deel 3 van deze studie ontwikkelt de auteur, mede op basis van de bevindingen in de eerste twee delen, een zelfstandig en van het schadevergoedingsrecht ontkoppeld systeem voor de verplichting tot voordeelsafgifte. Hij baseert dit op het leerstuk van de ongerechtvaardigde verrijking. De ongerechtvaardigde verrijking zoals in 1992 geregeld in artikel 6:212 BW wordt kritisch besproken en op diverse punten worden fundamentele wijzigingen voorgesteld. Het schadevergoedingskarakter van het Nederlandse verrijkingsrecht wordt verworpen, evenals bijvoorbeeld de opvatting dat een actie uit ongerechtvaardigde verrijking een 'restactie' of 'subsidiair hulpmiddel' is. Volgens de auteur gaat het in het verrijkingsrecht om afgihe van (het concreet of abstract begrote) voordeel dat is verworven door bijvoorbeeld het gebruiken, uitoefenen of exploiteren van aan een ander voorbehouden rechten en bevoegdheden. Geconcludeerd wordt onder andere dat het Nederlandse verrijkingsrecht langs deze weg een dynamische werkingssfeer verkrijgt, waarmee kan worden ingespeeld op de maatschappelijke en juridische ontwikkelingen rond beschermenswaardige en aan een rechthebbende voorbehouden rechten en bevoegdheden.
