While energy has been extracted from the ground for two centuries, recent years have seen transformative changes to how easy it is to access underground energy resources. This book investigates the key challenges and legal consequences of recent developments in the use of the subsurface as a source of energy. Al situarse en este territorio la mayor densidad poblacional del país, se plantean problemáticas ambientales relativas a las difíciles condiciones de escurrimiento, la adaptación de la urbanización al medio natural y la degradación de los cursos. ¿Cómo se ha construido a lo largo de la historia la relación entre medio natural y urbanización en la región? ¿Cómo se ha ido incorporando el tema ambiental en el ordenamiento territorial? ¿Cuál es el tratamiento actual de las cuencas? Son interrogantes que intenta responder este artículo, puntualizando el análisis en la cuenca más poblada del Gran La Plata, la del arroyo del Gato. El Riachuelo se asocia inmediatamente con un paisaje urbano altamente contaminado, un territorio de asentamientos para la población más pobre y desprotegida de la ciudad y décadas de inacción de los Estados. Sin embargo, los problemas sociales vinculados a la contaminación permanecieron invisibles hasta 2006, cuando la Corte Suprema de Justicia de la Nación declara su competencia en una causa relacionada con la contaminación y coloca la recomposición ambiental del Riachuelo como tema central de la política de Estado para garantizar el orden público ambiental. Gabriela Merlinsky reconstruye la larga historia de invisibilización y la más reciente de manifestación pública de los reclamos ambientales para examinar la conformación de un proceso de movilización política en torno a la recomposición ambiental del Riachuelo. Así, el «conflicto Riachuelo» representa un punto de inflexión para la problemática ambiental, ya que ha sido capaz de producir transformaciones sociales, jurídicas, institucionales y territoriales en el ámbito público en el que se construyen y redefinen tales problemas. En este ensayo lúcido e innovador, Merlinsky pone al descubierto una forma de desigualdad que suele pasar desapercibida: la injusticia ambiental; es decir, la concentración desproporcionada de peligros ambientales en los territorios de mayor relegación social y sobre los ciudadanos con menor poder político y económico. En tal sentido, sostiene: «El conflicto del Riachuelo representa una oportunidad para repensar los procesos de diferenciación y segregación que orientaron históricamente el desarrollo de la ciudad. Y también, si prolongamos el ejercicio de imaginación institucional, permite abrir un debate sobre escenarios futuros con respecto a qué ciudad queremos y con qué criterios de justicia se definirán las decisiones de políticas públicas».
