This draft Environmental Code is intended to bring together, unify, harmonise, develop and update German environmental law. The codification project takes up a transnational legal trend that has already led to the passing of similar legislation in a number of countries such as the Netherlands, Switzerland and the United Kingdom or the preparation of corresponding drafts, as in France, Sweden, Poland and Hungary. The European Union is also looking into the codification of environmental law. The Commission's draft applies the principle of sustainable environmentally sound development and establishes an integrated cross-media approach in all areas of environmental legislation. One of its principal features is the unified project authorisation model (Vorhabengenehmigung) for environmental legislation, which the Federal Government intends to use as a basis for the planned implementation of the IPPC Directive in a first volume of an Environmental Code. Other aims pursued by the Commission were to strengthen the responsibility of enterprises and of society, develop incentive instruments and expand transboundary environmental protection. The draft was prepared between autumn 1992 and summer 1997. The Commission consisted of eight experts with practical experience in the field of environmental law as judges, university teaching staff, lawyers, administrative officials and an environmental officer in a large industrial company. This volume contains the English translation of the draft. It seeks to make a contribution to international and European discussions about the harmonisation and codification of environmental law. For this reason the introduction to the English version also contains observations about the German legal system and existing environmental legislation which should make it easier for the reader to understand the proposals.

Several major statutes form the legal basis for the programs of the Environmental Protection Agency (EPA). Many of these have been amended several times. The current provisions of each are briefly summarised in this report. The Pollution Prevention Act (PPA) seeks to prevent pollution through reduced generation of pollutants at their point of origin. The Clean Air Act (CAA) requires EPA to set mobile source limits, ambient air quality standards, hazardous air pollutant emission standards, standards for new pollution sources, and significant deterioration requirements; and to focus on areas that do not attain standards. The Clean Water Act (CWA) establishes a sewage treatment construction grants program, and a regulatory and enforcement program for discharges of wastes into U.S. waters. Focusing on the regulation of the intentional disposal of materials into ocean waters and authorising related research is the Ocean Dumping Act. The Safe Drinking Water Act (SDWA) establishes primary drinking water standards, regulates underground injection disposal practices, and establishes a groundwater control program. The Solid Waste Disposal Act and Resource Conservation and Recovery Act (RCRA) provide regulation of solid and hazardous waste, while the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), or Superfund, provides authority for the federal government to respond to releases of hazardous substances, and established a fee-maintained fund to clean up abandoned hazardous waste sites. The authority to collect fees has expired, and funding is now provided from general revenues. The Emergency Planning and Community Right-to-Know Act requires industrial reporting of toxic releases and encourages planning to respond to chemical emergencies. The Toxic Substances Control Act (TSCA) regulates the testing of chemicals and their use, and the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) governs pesticide products and their use.

"Over the last years, voluntary environmental codes of conduct have come to the fore as a new and promising tool to raise awareness of environmental issues and improve behaviour and practices. They provide an interesting complement to other tools such as regulations and economic instruments. Chapter 30 of Agenda 21 encourages business and industry "to adopt and report on the implementation of codes of conduct promoting best environmental practice". Within the tourism industry they are now sufficiently numerous and widespread to warrant an interim review of their content and effectiveness.
