In the wake of the euphoria consequent to the Soviet space forays and the US landing on the moon, innovative space law evolved rather rapidly in just two decades and then came a stalemate. In this hasty growth of nascent space law, some gaps remained, some inadvertently due to lack of vision and some deliberately, due to lack of consensus or because half-baked concepts remained pending till the achievement of a better understanding of space phenomena or development of supportive technology. These issues have since started jumping to centre-stage and this book falls in this niche of deficiencies. A few challenges and unresolved contingencies that stare us in the face, needing to be addressed suitably, are space jurisprudence in jus cogens of space law, pointers on policy issues for India, hesitancy to incorporate international cooperation in domestic space statutes, futility of reiteration of the Convention Law in International Codes of Conduct as soft law adjuncts, absence of a legal regimen governing mining on asteroids by private enterprises, explication of the concept of Common Heritage of Mankind and modalities for sharing of benefits between nations, procedure for nomination of an astronaut as an envoy of mankind in space by name or designation to avoid confusion in the eventuality of multiple astronauts of multiple nationalities, all being at one place at the same time, et al. This book is a modest effort to help resolve issues in that direction.

For a long time what we now know as space was inaccessible to humans, not because it was at a height which was unattainable without the least astronautical technology or principles, but because of the cosmic and dualistic representation of reality. Humans were relegated to the centre, to a sort of ecesspiti of imperfection, alteration, incompleteness and finally death. Around them were crystal spheres which held the planets and starsoimmutable, eternal and perfectoa domain which was completely off-limits to humans, unless they had discarded their carnal envelope, either through a mystical experience or after death. It took a revolution, the Copernican Revolution, to shatter the celestial spheres and make them no longer forbidden territory. Galileo was one of the first revolutionaries: through his astronomical observations, he showed the Earth and the Sky were in fact made of the same fabric, the same material, and therefore belonged to the same world. Then followed Kepler and others. Centuries passed, and human conquered the air, and then space. Their feet touched the surface of the Moon and their wheels the surface of Mars. The Earth and the entire universe somehow became flat again with no folds, no curves, at least in appearance, to hide any dark corners. The horizon once again retreated out of reach taking with it perhaps the last dreams of exploration. The human imagination does not like horizons which are too flat, too clear; humanity needs to meet resistance, brakes, constraints to stop them in their tracks, to cross them and lead them, to new unknown territories. Space exploration is a development which began with the launching of the first artificial satellite in 1957. Since then an incredible progress has been made, leading to the landing of man on the moon. A quick look at the number of launchings which have been registered with the United Nations will show the influence of space science and technology on human endeavours. For example, satellites can be used for com munication, weather forecasting, education, and remote sensing of the resources of the Earth. The United Nations Committee on the Peaceful Uses of Outer Space is the focal point of international co-operation in space activities. The Committee regulates these activities through its Legal Sub-Committee. The setting up of the Committee was preceded by an Ad Hoc Committee which was established on 31 December 1958. The initial difficulty which confronted the Ad Hoc Committee was the issue of its member ship. The USSR, Czechoslovakia and Poland decided not to participate in its work because they were dissatisfied with the composition of the Ad Hoc Committee. Later, both the UAR and India also decided not to participate in its work. Although the Ad Hoc Committee succeeded in producing a report in 1959 (UN document A/4141), the progress of work of the Main Committee was in limbo for a while. It was not until 1961 that the disagreements were resolved. The Committee conducts its business without voting -the Chairman simply states the consensus of views which have been expressed.

Export controls definitively impact international cooperation in outer space. Civil and commercial space actors that engage in international endeavors must comply with space technology export controls. In the general discourse, members of the civil and commercial space community have an understanding of their domestic export control regime. However, a careful reading of the literature on space technology export controls reveals that certain questions relevant to international engagements have not been identified or answered. What is the legal-political origin of space technology export controls? How do they relate to the current international legal structure? What steps can be taken to evolve our current unilateral paradigm of space technology within the context of peaceful exploration and use of outer space? In this book, these and other relevant questions on space technology export controls are identified and assessed through an insightful case-study of the U.S. commercial communication export control regime. The findings of this case-study are used in an international legal-political analysis of international space law, public international law, and international cooperation. Breaking new ground in international legal theory, a self-justified security dilemma that is manifest in international law is identified and explained as the origin for the current paradigm of space technology export controls.
