Excerpt from Equity and Its Remedies This book is the outcome of lectures delivered by the author at the Evening Law School of the Boston Y. M. C. A. And at the Law School of Boston Univer sity, on the equitable remedies. The justification for putting the material in this form is found in the expressions of gratitude from former students who have been good enough to say that they have found in these lectures citations and statements of principles inaccessible in any text-book. The frequency with which the author has turned to these notes for cita tions in his own practise has convinced him that others of the profession may be able to find assistance from the same source. The book is an attempt to give a rational outline of equity (exclusive of trusts and kindred subjects) and to show the scope of the equitable remedies. It does not attempt to deal with strictly statutory subjects or with equity pleading or practice. While the citations are largely drawn from Massa chusetts cases (and Ames's Cases on Equity), it is believed the subject is treated in such a way as to make the book of general application, useful to the student or practitioner in any part of the United States. No attempt has been made to cite all the equity cases decided in Massachusetts, although cer tain parts of the subject, not covered by existing text-books, have been treated with thoroughness. Between one-third and two fifths of the text has been omitted, and the greater part of the notes; all except/ such as seemed essential to a clear understanding of the text. No part of the text has been re-written. By the sacrifice of some details of comparatively little importance to the American student (as in the chapters on Election, Satisfaction, and Perform ance, 461 of matters peculiar to the jurisdiction in individ ual states (as in 299 and by the free use of cross references (e. G., see 70-88, 151 it has been found possible to preserve intact those full discussions of the foundation and rationale of the various equitable doctrines which are the chief excellence of the work. The index (with some regret) has been greatly shortened; on the other hand, the chapter analyses have been retained without omissions, for the purpose of showing the author's full scheme of treatment of the various subjects. Eaton, the author of this book, soon after the completion of the manuscript, and while it was yet in the hands of the printers, the making of such statement as may be helpful to the reader in regard to its purposes, scope, and preparation, which would have come more fitly and satisfactorily from him who had devoted to the work much of the last year of his life, devolves on the publishers. The general purpose of the author and the publishers has been to make a systematic, complete, and reliable presenta tion of Equity Jurisprudence, as full as is practicable within the limits of an ordinary volume, in the form and having the special features of the Hornbook Series, and, like others of the series, adapted to the needs both of the student and the practitioner. The Hornbook method, combining text, commentary, and annotation, seems peculiarly suitable for the treatment of this subject, in which general principles and maxims are so prominent and controlling, and their meaning and application are so fully illustrated by decided cases. The chief difficulty, indeed, arises from the great extent and variety of the subjects involved in the application of equi table doctrines. But while exhaustive treatment of spe cific subjects of equity jurisdiction is beyond the scope of this work, it is quite practicable to exhibit the application to each such subject of the various principles applicable, as fully as is useful in a general treatise.
