Economia ed ermeneutica. È la storia di un incontro precario, segnato da dure polemiche e logorato da imperdonabili equivoci. Una disputa intensa, sviluppatasi a partire dagli anni Settanta, che ha visto filosofi ed economisti scontrarsi duramente sullo statuto epistemologico della scienza economica. Raccogliendo la giusta intuizione degli interpretative economists, questo libro vuole dimostrare come l’ermeneutica possa rappresentare uno dei più efficaci strumenti nella «cassetta degli attrezzi» dell’economista, a condizione che si abbandoni quella diffusa ed errata concezione antiscientifica dell’ermeneutica e si accetti l’idea secondo la quale il «circolo ermeneutico » di H.-G. Gadamer e il metodo «problemi- teorie-critiche» di K.R. Popper, descrivono, con linguaggi diversi, il medesimo procedimento per la scoperta di conoscenze oggettive. Sulla base di questa impostazione risulta evidente come l’adozione della prospettiva interpretativa in ambito economico non solo non comporta una rinuncia all’oggettività, ma consente invece una più efficace applicazione del modello di spiegazione causale, permettendo di migliorare gli standard di scientificità delle teorie economiche.

Some, indeed practically all of us, reject this sort of epistemology of law, and where the hypothesis of the coherence of the legal universe is put forward, this is in order to define it in very noticeably different terms from those traditionally used in legal scholarly accounts. If this referent, the law presented as a full discourses, runs through all of the contributions, this is because reasoning by analogy has to be found its specific place within this legal culture. It is the place to locate the problem of "lacunae" in law, which at bottom allows our various contributions to be classified. With Zaccaria and Maris, the question of lacunae is accepted as such (this is, we might say, the "traditionalist" aspect of these two articles, which is counterbalanced by - keeping to the same terminology - "modernist" emphases, sometimes Dworkinian in nature), and becomes the backdrop for considerations of purely hermeneutic type, in Zaccaria, ex tended in Maris to the field of ethics. The papers from Lenoble and Jackson, the former philosophical and the latter semiological, take as their main tar get this legal knowledge where the theory of lacunae finds its place.

Essi dimostrano che la teoria politica ed economica e quelle monetarie e fiscali dell’Ordoliberalismo contrastano radicalmente con le tesi fortemente critiche di questa tradizione di pensiero. Dai saggi risulta evidente come il pensiero ordoliberale si sia venuto strutturando secondo due livelli: il primo, dovuto soprattutto a Wilhelm Röpke, che integra le teorie di Walter Eucken con la teoria della persona umana, e il secondo, a cui ha contribuito principalmente Alfred Müller-Armack, che ha approfondito la riflessione sugli aspetti più propriamente sociali. I testi di Eucken confutano la tesi secondo la quale le regole costituzionali economiche e monetarie dell’Ordoliberalismo sarebbero una sorta di gabbia di ferro.
