In a world gripped by an ever-worsening ecological crisis there are present and increasing genocidal pressures on many culturally distinct social groups, such as indigenous peoples. This is where the genocide-ecocide nexus presents itself. The destruction of ecosystems, ecocide, can be a method of genocide if, for example, environmental destruction results in conditions of life that fundamentally threaten a social group's cultural and/or physical existence. Given the looming threat of runaway climate change, the attendant rapid extinction of species, destruction of habitats, ecological collapse and the self-evident dependency of the human race on our bio-sphere, ecocide (both "natural" and "manmade") will become a primary driver of genocide. Through nine chapters of cutting-edge research, this book examines specific case studies in geographical settings such as Iraq, Sudan, Nigeria and Brazil, to highlight and analyse the crucial connections and vectors of the genocide-ecocide nexus. This book will be of great value to scholars, students and researchers interested in the ecological crisis, Environmental Justice, the political economy of genocide and ecocide as well as environmental human rights. This book provides a broad perspective of the functioning, evolution, and dynamics of the rule of law in Brazil. It stresses not only how the rule of law has developed in the legal system, but also how the political institutions and extra-legal organisations have transformed its foundations. The rule of law is not a simple concept when it comes to defining the political, economic, and legal developments of a country like Brazil. Similar to many other Latin American countries, Brazil is a young democracy struggling with its longstanding extractive institutions and entrenched interests. It features, however, one of Latin America's richest constitutional moments, when civil society actively participated in drafting the most democratic constitution in the country's history. Brazil has since strengthened its institutions and the rule of law, but the road toward consolidating them has been challenged by inequality and the legacies of that authoritarian past. The book explores how Brazilian democracy has dealt with the high levels of social inequality and the authoritarian mindset that still play a big role in its fate, and asks whether the country's democratic achievements and institutional framework are sufficiently strong to enforce the rule of law as an imperative for Brazil's development, especially in times when the country is most in need of them.

This present book examines some of the key features of the interplay between legal history, authoritarian rule and political transitions in Brazil and other countries from the end of 20th Century until today. This book casts light on these aspects of the role of law and legal actors/institutions. In the context of transition from authoritarian rule to democratic state, Brazil has produced a significant literature on the challenges and shortcomings of the transition, but little attention has been given to the role of law and legal actors/institutions. Different approaches focus on the legal mechanisms, discourses and practices used by the military regime and by the players involved in the political transition process in Brazil. A comparative perspective that takes into account different political transitions – and their legal consequences – in Europe and Latin America complements the analysis. Part 1 (4 essays) discusses some of the central issues of political transition and legal history in contemporary Brazil, focusing on the time of the transition (and its effects on transitional justice) with different perspectives, from racial and gender issues to constitutional reform and police repression. Part 2 (3 essays) brings the comparative studies on South American experiences. Part 3 (4 essays) analyses different cases of transition to democracy in Chile, Portugal, Spain and Italy. Part 4 (3 essays) proposes a historiographical and methodological approach, considering the politics of time involved in the interplay between political transitions and legal history.

Fruto de um seminário realizado na Universidade de São Paulo (USP), em 2008, o livro reúne textos de escritores e intelectuais como Maria Rita Kehl, Jaime Ginzburg, Paulo Arantes, Ricardo Lísias e Jeanne Marie Gagnebin, que buscam analisar o que permanece de mais perverso da ditadura no país hoje. O mundo ocidental, nas primeiras décadas do século XXI, se vê às voltas com manifestações muito semelhantes às que ocorreram nas décadas de 20 e 30 do século XX. A extrema direita se avoluma, assim como os ingredientes político-econômicos que a estimulavam: crises macroeconômicas, carestia, insegurança de empregos, frustrações de expectativas, de estabilidade, de empregabilidade, de renda, de seguridade social, etc. Como é amplamente reconhecido, o fascismo é, sobretudo, filho do medo e, como decorre desse afeto, seu desdobramento tende a ser a violência. Violência e medo se implicam mutuamente no mundo da consequencialidade comportamental social. O fascismo se apropria de afetos como o recalque, a insegurança, o desamparo e a vulnerabilidade, e os mobiliza em prol do ódio. O ódio que alimenta a organização de movimentos, partidos que prometem amparo, segurança, superioridade. Enfim, são ilusões, mas as ilusões são poderosas pois constroem presentes, constroem a realidade prática que se materializa a partir da ação dos indivíduos.
