Carl Schmitt’s magnum opus, Constitutional Theory, was originally published in 1928 and has been in print in German ever since. This volume makes Schmitt’s masterpiece of comparative constitutionalism available to English-language readers for the first time. Schmitt is considered by many to be one of the most original—and, because of his collaboration with the Nazi party, controversial—political thinkers of the twentieth century. In Constitutional Theory, Schmitt provides a highly distinctive and provocative interpretation of the Weimar Constitution. La publicación, compuesta por dos tomos, con cerca de 1400 páginas, reúne de forma íntegra los trabajos presentados en el marco del X Congreso de las Academias Jurídicas de Iberoamérica, evento que tuvo lugar en Madrid el 22, 23 y 24 de noviembre de 2018, organizado por la Real Academia de Jurisprudencia y Legislación de España y convocado por la Conferencia Permanente de las Academias Jurídicas de Iberoamérica, entidad compuesta por las Academias nacionales de España y sus homólogas al otro lado del Atlántico. Al citado encuentro asistieron los presidentes y/o representantes de las instituciones integrantes de la mencionada Conferencia; cerca de 300 congresistas que aportaron casi 100 comunicaciones a las 6 ponencias presentadas, en las que se abordaron diversas cuestiones que en la actualidad preocupan a los juristas y a la sociedad en su conjunto: el Estado de Derecho frente al populismo y la corrupción; el desarrollo del Derecho en el marco del desarrollo tecnológico; el Derecho Mercantil y la globalización; el Derecho Civil en Iberoamérica y sus interconexiones entre los diversos países; los derechos humanos y su efectiva tutela estatal, y, por último, lo público y lo privado en el Derecho. La obra se abre con los discursos de la sesión de apertura y continúa con las seis secciones que conformaron el Congreso, constituida cada una de ellas por una ponencia, sus comunicaciones y unas conclusiones finales, cerrándose con un apéndice documental con información extraída del documento-resumen realizado a la clausura del Congreso por la organización del mismo.
