Peut-on encore penser la justice constitutionnelle à travers les modèles ? Cette question est à l'origine de l'étude, qui propose d'y répondre par l'affirmative, à rebours d'une forme de renoncement doctrinal en la matière. À visée exploratoire, l'ouvrage expose une modélisation théorique dans une perspective descriptive, se présentant comme un outil susceptible de permettre de mieux connaître les systèmes de justice constitutionnelle. Prolongeant, tout en la reformulant, la proposition de Francisco Rubio Llorente (1996), la thèse suggère de s'intéresser aux finalités de la justice constitutionnelle. Dans une première partie, l'étude approfondie du contentieux constitutionnel français permet de systématiser sa reconfiguration autour des droits et libertés et fournit une grande part du matériau utile à la construction théorique. Appréhendés comme des idéaux-types, à vocation universelle, deux modèles sont élaborés, dans une seconde partie : le modèle de justice constitutionnelle ayant pour finalité prioritaire la préservation de la séparation des pouvoirs et celui ayant pour priorité la protection des droits et libertés. À l'appui d'une étude de droit comparé (Allemagne, Espagne, Italie, Belgique), la thèse permet de conforter l'idée selon laquelle le contentieux constitutionnel, généralement institué pour préserver les sphères de compétences, tend à se recentrer progressivement vers la protection des droits et libertés dans les États de droit contemporains. Cette évolution met en évidence celle de la nature du contrôle juridictionnel, reformulant la problématique de la légitimité de la justice constitutionnelle.

Le besoin de sécurité règne sans partage. Dans le contexte post-11 septembre 2001 marqué par la permanence de la menace terroriste, il se traduit par un emballement sécuritaire au combien préoccupant. La consolidation permanente de l'arsenal policier contraste fortement avec la tradition libérale de notre droit selon laquelle "la liberté est la règle, la restriction de police l'exception". En ancrant au coeur de la politique publique de sécurité intérieure l'existence d'un "droit fondamental à la sécurité", le législateur semble même avoir renversé le principe et l'exception. C'est en observant ce glissement sécuritaire qu'apparaît l'opportunité de mettre en exergue les mécanismes qui régissent les rapports entre la Constitution et la sécurité intérieure. Par une entreprise inédite de modélisation juridique, cette thèse offre une "grille de lecture" qui, pour tout dispositif policier (vidéoprotection, relevé ou contrôle et vérification d'identité, garde à vue, sonorisation de lieux ou de véhicules, etc.), indique les limites constitutionnelles d'ordre substantiel à observer. Son principal intérêt réside dans sa fonction prédictive : elle constitue un atout essentiel pour qui cherche à étudier, à élaborer ou à contrôler une mesure de police. Assis essentiellement sur une analyse minutieuse de la jurisprudence du Conseil constitutionnel, cet essai de modélisation des rapports Constitution et sécurité intérieure se présente comme un acquis indispensable pour la résolution des conflits entre les droits et libertés fondamentaux et l'ensemble des dispositifs policiers.

Recent confrontations between constitutional courts and parliamentary majorities in several European countries have attracted international interest in the relationship between the judiciary and the legislature. Some political actors have argued that courts have assumed too much power and politics has been extremely judicialized. Yet the extent to which this aggregation of power may have constrained the dominant political actors’ room for manoeuvre has never been examined accurately and systematically. This volume fills this gap in the literature. To explore the diversity and measure the strength of judicial decisions, the authors have elaborated a new methodology that is intended to give a more nuanced picture of the practice of constitutional adjudication in Europe. The work opens with an assessment of the existing literature on empirical analysis of judicial decisions with a special focus on Western Europe and a short summary of the methodology of the project. This is followed by 11 country studies and a concluding chapter providing a comprehensive comparative analysis of the results. Jusqu’en 2010, le contrôle de constitutionnalité de la loi en France était exclusivement a priori et sur saisine d’autorités politiques. L’entrée en vigueur de la QPC, permettant au justiciable d’alléguer, au cours d’un procès ordinaire, la contrariété de la loi applicable à ses droits et libertés constitutionnels, a donc été saluée comme mettant fin à une exception française au sein du modèle européen de justice constitutionnelle. Pourtant, aucune mise en perspective de cette nouvelle procédure avec celles existant dans les pays proches n’avait été entreprise à ce jour. L’ouvrage y remédie à travers une comparaison systématique des questions de constitutionnalité en France, Espagne et Italie, élargie de façon plus ponctuelle à d’autres exemples (Allemagne et Belgique). Les atouts et faiblesses des différents mécanismes nationaux sont mis en lumière par l’analyse successive des procédés de filtrage de la question, du jugement de la Cour constitutionnelle et de ses suites ainsi que de l’insertion de la question dans l’environnement juridictionnel global. La comparaison invite en définitive à une réflexion plus générale sur l’évolution des systèmes de justice constitutionnelle à l’heure de la pluralité des juges des droits fondamentaux. Condorcet (1743–1794) was the last of the great eighteenth-century French philosophes and one of the most fervent américanistes of his time.
