"Existen situaciones excepcionales de peligro para determinados bienes jurídicos que solo pueden contrarrestarse por medio de la afectación de otro bien jurídico. En estas se genera, en consecuencia, un conflicto entre bienes, intereses o males llamado estado de necesidad. Tal circunstancia fáctica, ocasiona que los agentes, con el propósito de alcanzar un objetivo, realicen acciones que afecten otros bienes. En algunos casos, estos deberán ser lesionados e incluso sacrificados para que el resto no perezca. Pese al trabajo dogmático de los juristas por identificar y resolver estos casos de conflicto, no existe claridad sobre qué es el estado de necesidad. Se ha debatido en la dogmática jurídico-penal especialmente en torno a su efecto y extensión, sin atender mayormente a su noción. Por ende, su determinación se considera aún en vías de gestación. Por eso, la obra advierte relaciones del estado de necesidad con otras eximentes, en nuestra dogmática, que relevan un problema: ¿de qué estamos hablando cuando aludimos al estado de necesidad? Así pues, la investigación examina la esencia del estado de necesidad, con el objeto de entregar seguridad jurídica respecto del alcance y límites de la aplicación de la eximente en la jurisprudencia".

In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect.
