Retomando el problema de la banda de ladrones este libro realiza una interpretación y análisis crítico de las respuestas más sobresalientes que se han dado al asunto de la legitimidad a partir del siglo XX, permitiendo dilucidar dos modelos de justificación del poder político: legitimidad como legalidad formal y legitimidad como legalidad democrática. Los dos modelos hacen de la legalidad el criterio fundamental de la legitimidad, pero se diferencian porque para el primero se trata de un criterio formal, que puede ser satisfecho por cualquier tipo de legalidad, mientras que para el segundo la legalidad tiene que obedecer a criterios materiales como la justicia, el consenso y un proceso de construcción democrático.
