El libro nace de una propuesta originaria del Consejo Directivo de nuestra Universidad, a los pocos días del fallecimiento de quien fuera para nosotros, a la vez, Rector y Maestro, y se incluye dentro de una serie de conmemoraciones que tendrán lugar durante el mes de marzo de 2014. También con esta obra se pretende entonces exaltar la memoria de Fernando Hinestrosa para revalidar lo imperecedero de su magisterio: fue así como se invitó a profesores amigos a escribir sobre temas que a él le eran caros. Ahora bien, el primer problema que surgió fue el de la escogencia de los temas afines a nuestro Maestro, puesto que, como ya lo he dicho, su mente era universal y, por ende, inabarcable. ¿Incluir temas de educación, de historia, de derecho, de arte…? ¿Restringirnos a lo jurídico? Y, en caso afirmativo, de nuevo, ¿a qué áreas? Difícil decisión, frente a la cual se optó finalmente por una solución sencilla: solicitar escritos que tuvieran relación con los temas jurídicos más tratados por el homenajeado. La coordinación de la obra estuvo a cargo de la profesora Emilssen González de Cancino y de los profesores Felipe Navia Arroyo y Édgar Cortés Moncayo quienes, con la ayuda del Departamento de Publicaciones de la Universidad, realizaron traducciones, ajustaron estilos y clasificaron los artículos recibidos. En la obra se recuerda entonces al Maestro, de manera especial, como profesor de derecho privado, de derecho romano y de historia del derecho.

In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect. A postscript written for the English edition considers critiques of the Theory since it first appeared in 1985, focusing in particular on the discretion left to legislatures and in an extended introduction the translator argues that the theory may be used to clarify the nature of legal reasoning in the context of rights under the British Constitution.
