This book examines the process of dismantling the democratic institutions and protections in Venezuela under the Hugo Chávez regime. The actions of the Chávez government have influenced similar processes and undemocratic manoeuvrings in Ecuador, Bolivia, and Honduras. Since the election of Hugo Chávez as president of Venezuela in 1998, a sinister form of nationalistic authoritarianism has arisen at the expense of long-established democratic standards. During the past decade, the 1999 Venezuelan Constitution has been systematically attacked by all branches of the Chávez government, particularly by the Supreme Tribunal of Justice, which has legitimized the Chávez-ordered constitutional violations. The Chávez regime has purposely defrauded the Constitution and severely restricted representative government, all in the name of a supposedly participatory democracy controlled by a popularly supported central government. This volume illustrates how an authoritarian, nondemocratic government has been established in Venezuela.

Para que la Justicia Constitucional pueda, por tanto, enfrentarse al Poder y someterlo a la Constitución en nombre del pueblo, la condición más esencial es que tiene que estar a cargo de un órgano autónomo e independiente. Solo así puede controlar al Poder; de lo contrario, se torna en un órgano controlado por el Poder y, por tanto, en el más vil instrumento de éste para violar impunemente la Constitución. Los casos judiciales analizados en este libro muestran precisamente la oscilación que existe entre Jueces Constitucionales impartiendo justicia, controlando al Poder y, con toda autonomía e independencia, defendiendo la Constitución; y Jueces Constitucionales controlados por el Poder, sin autonomía alguna, despreciando la Constitución. En todos los casos analizados se resolvieron cuestiones constitucionales de variada naturaleza, pero de particular importancia en los respecticos países, que pusieron a prueba la independencia y autonomía de los Jueces Constitucionales, que en definitiva es el signo esencial para que realmente exista un Estado de derecho y un régimen democrático".

"En todos los ordenamientos jurídicos contemporáneos en el marco del Estado de Derecho, en mayor o menor grado, las actividades que los particulares tienen derecho a realizar conforme a la libertad individual y económica garantizada en la Constitución, con frecuencia está sujeta a limitaciones impuestas por las leyes por razones de interés general, sometiéndolas, entre otros requisitos, la obtención previa por aquellos, de alguna autorización, licencia, permiso o registro administrativo por parte de la Administración del Estado. Sin embargo, con frecuencia, la Administración no siempre decide las peticiones que se le formulan, teniendo que enfrentarse los peticionarios con una situación de inactividad, de silencio o de omisión por parte de la Administración, quedando el ejercicio de sus actividades, que tienen derecho a realizar, en suspenso. Para remediar esta situación, y como garantía de los derechos de los administrados, los ordenamientos jurídicos han establecido la presunción de considerar como decidida las peticiones una vez que el plazo establecido para la respuesta oportuna ha vencido, garantizándosele así el derecho al interesado de poder defenderse ejerciendo un recurso administrativo o contencioso administrativo contra el acto administrativo tácito derivado del silencio negativo. Ese beneficio, en todo caso, solo se establece a favor del administrado y no de la Administración, la cual por el transcurso del plazo no deja de estar obligada a decidir. En otros casos, para proteger los derechos de los particulares, los ordenamientos jurídicos le han atribuido efectos positivos al silencio de la Administración, considerándose que con el transcurso de lapso dispuesto para que la Administración decida, sin que la misma se haya pronunciado, se considera que la petición formulada ha sido otorgada". Territorial autonomy in Spain has reached a crossroads. After over thirty years of development, the consensus regarding its appropriateness has started to crumble. The transformation project embodied by the reform of Statute of Catalonia (2006) has failed to achieve its most significant demands. Although the concept of Spain as a Federation is disputed -more within the country than beyond-, the evolution of the Spanish system needs to follow a markedly federalist path. In this perspective, reference models assume critical importance. This edition gathers the works of a broad group of European, American and Spanish experts who analyse the present-day challenges of their respective systems. The objective, thus, is to contribute ideas which might help to address the evolution of the Spanish system in the light of the experience of more established Federations.
