This book challenges the view, common among Western scholars, that precolonial India lacked a tradition of military philosophy. It traces the evolution of theories of warfare in India from the dawn of civilization, focusing on the debate between Dharmayuddha (Just War) and Kutayuddha (Unjust War) within Hindu philosophy. This debate centers around four questions: What is war? What justifies it? How should it be waged? And what are its potential repercussions? This body of literature provides evidence of the historical evolution of strategic thought in the Indian subcontinent that has heretofore been neglected by modern historians. Further, it provides a counterpoint to scholarship in political science that engages solely with Western theories in its analysis of independent India's philosophy of warfare. The earliest completed code of the British army dates back to the 14th century when the “Statutes, Ordinances and Customs” were issued by Richard II to his Army in 1385 on the occasion of war with France. These statutes called “Articles” or “Ordinances of War” were issued under the prerogative power of the Crown. The earlier Articles were of excessive severity prescribing death or loss of limb as punishment for almost every crime. There were thousands of instances of accused native soldiers being blown from a gun on the orders of their commander. As minor punishment, an accused could be branded with hot iron for swearing. He could even be flogged in public or ordered to ride the wooden horse. This book provides an insight into the origin and development of the legal system of the Indian Army from the year 1600 to 1947 including that of the Navy and Air Force. A total of 40 statutes passed by the British Parliament and the Articles of War issued by the Crown for governing the military forces during that period have been included. India does not admit easily to broad generalizations. It is an extraordinarily complex and diverse society and Indian elites show little evidence of having thought coherently and systematically about national strategy, although this situation may now be changing. Despite India`s cultural greatness and longevity as a civilization, Indian history is often dimly perceived and poorly recorded; given an oral tradition in imparting past events and the destruction of most records, much of this history is difficult to verify. Until the middle of the eighteenth century, Indians knew little of their national history and seemed uninterested in it. Four principal factors help to explain Indian actions and views about power and security: Indian geography; the discovery of Indian history by Indian elites over the past 150 years; Indian cultural and social structures and belief systems: and the British rule. Geography has imparted a view of the Indian subcontinent as a single strategic entity, with various topographical features contributing to an insular perspective and a tradition of localism and particularism. India`s unique culture reinforced this unity and imparted, first, a tendency toward diversity and accommodation to existing realities and, second, a highly developed capacity to absorb dissimilar concepts and theories. This tolerance was strengthened by the caste system, which also helped maintain an extraordinarily durable system and ethic for social relations.
