At the moment, and in the longer run, the energy/climate change challenge is one of the greatest tests facing the EU and its Member States. The need to deliver the triple objectives of the EU's energy policy - namely a competitive, secure, and sustainable energy supply - is stronger than ever. It will take decades to steer the energy system into a more secure and sustainable system. However, the decisions needed to set the EU and its Member States on the right path should be taken now. To ensure that today's customers and those of tomorrow are supplied with competitively priced, secure, and sustainable supplies of electricity, the European energy market requires an over-arching EU legal regulatory framework. An efficient EU regulatory framework for energy law and policy will not only allow the EU and its Member States to achieve the triple objectives, but will also generate the right investment signals for potential investors. It should provide all the market players, such as generators and network operators, with real and effective incentives to invest in the EU energy market. The overall objective of this book is to analyze whether the current EU regulatory framework for energy law and policy suffices to address the triple objectives of the EU's energy policy, or by contrast, whether changes to that framework are needed.

'This book analyses a highly important topic. It is based on a comprehensive and empirically rich assessment of European energy policy, including both internal and external determinants. Its encompassing approach and the thoughtful combination of different analytical perspectives makes the book an important and fresh contribution to the field.' Christoph Knill, University of Konstanz, Germany 'Energy was one of the founding pillars of European integration, while environmental concerns have become an identity sign of today's European Union energy policy. However, notwithstanding the obvious links between both issues, little attention has been devoted to the complex relationship between the EU's environmental performance and the Europeanization of its energy policy. This book, carefully edited by Morata and Solorio, has come to fill this gap becoming a "must" to understand the interactions between these two fundamental drivers of EU policies.' José María Marín-Quemada, Universidad Nacional de Educación a Distancia, and Member of the Governing Council of the Spanish Central Bank, Spain This path-breaking book explores the new European energy policy, highlighting the significance of environmental policy concerns, instruments, and objectives vis-à-vis competing security and market dimensions in order to achieve an all-embracing EU energy policy perspective for the future. While the past years have witnessed unprecedented development of EU energy policy, the understanding of this process has lagged behind. Alongside the scarce literature on this emergent policy, there is also a gap regarding the attention paid to its different components. The study stems from the perception of a mismatch between the valuable debate that certain dimensions of energy policy namely, energy security and the market and competition framework have triggered and the neglect of its environmental and climate change dimensions. European Energy Policy will prove to be insightful for academics and postgraduate students interested in European integration, political science, international relations, public policy and environmental science. Energy stakeholders and governmental policymakers will also find plenty of invaluable information in this enriching resource.

La 4e de couverture indique : "Since the introduction a quarter-century ago of market-based investments in the production of electricity and other critical services, our awareness of the underlying issues affecting the supply and consumption of energy has changed radically. No longer can Europe (or any region) rely on over-capacity of electricity generation and inexpensive primary energy fuels, or disregard the signs of potentially catastrophic climate change. The author of this timely and sharply focused book shows that, in the light of our current knowledge, ensuring new investments - and the right investments - in electricity generation constitutes an urgent energy policy challenge facing the EU over the coming decades. He accordingly makes the case for a serious reconsideration of the market facilitation and market intervention rules under electricity market legislation in the EU. In the first detailed legal analysis of the EU's internal electricity market framework for investments in electricity generation facilities from the perspective of security of supply, this book cover such legal issues as the following in precise detail : applicability of the Treaty on the Functioning of the European Union (TFEU) ; security of supply as a ground for exemption on the basis of public security ; justifications of public intervention ; the applicability of EU State aid provisions to investments in energy security ; requirements imposed by EU law on Member States for ensuring cost-efficient investments in European supply security ; facilitation of renewable energy sources and cogeneration in the environmental interest ; the Court of Justice's approach to Member State interventions ; the Court's decisions on restrictions on free movement in the environmental interest ; Member States' right to launch tendering procedures for new generation capacity ; Member States' right to impose public service obligations in the general economic interest on certain undertakings ; and relationship between the provisions of the TFEU and those of the Euratom Treaty in relation to investments in nuclear power generation. Throughout the study, in addition to his analysis of the decisions of the Court of Justice and the Court of First Instance, the author takes into account legal literature and Union reports, preparatory works, and working papers. The book demonstrates convincingly that today's energy supply challenges must be based on a broader balancing of security, competitiveness and sustainability interests. It suggests that the internal electricity market provisions of the Electricity Directive and the Security of Electricity Supply Directive would benefit from focusing more intensely on requiring investments in technologies and primary energy sources that will help mitigate climate change and reduce European energy import dependency, and less on the need for ensuring cost-efficient investments through market-based means. Through its detailed analysis of EU law in an area of great significance to both market participants and the public sector, Investing in EU Energy Security will be welcomed by legal advisors, whether working for the EU electricity industry or public agencies responsible for implementation of internal electricity market measures, as well as by academics in this hugely important field of current research."

A critical overview of European Union energy law and policy, this book takes a law-in-context approach as it examines the development of EU energy law from the 1950s to the present day. It discusses the development of EU energy law; the application of general EU law into energy; the regulation of EU energy markets; international aspects of EU energy law; and policy, sustainability, and energy regulation. Presenting an up-to-date overview of EU energy law and policy and a critical analysis of its sub-areas, the book extends the discussion from electricity and natural gas markets to other areas of energy, including oil. This holistic approach to the subject is then placed within the broader context of the international geopolitical sphere which EU energy law and policy operates, as the author considers the impact of regional and international energy policies and markets on the EU markets and the overall EU policy. He also draws on the wider context and takes into account non-legal factors such as the impact of unconventionals, the rise of the BRICS, and the 'Arab spring'. The book frames EU energy law as a topic that can provoke intellectual, political, and professional discussion about the slowly moving train of economic regulation under the typical pressures and contradictions of countries and the European Union in the global economy.

The discussion about energy perspectives beyond 2020, up to 2030 and eventually 2050 has started. There seems to be a verbal consensus on the necessity of ambitious climate change mitigation policies, without a convincing perspective of the necessary policy decisions to be reached in due time. Methods to achieve greenhouse gas reduction as well as energy security vary from aiming for 100% renewable energies and setting up appropriate policy frameworks to implementing a mix of renewables comprising so-called clean fossil and nuclear energy. This book provides an analysis of the different approaches and the reasons why there is no sustainable alternative to aiming for 100% renewables – and how this vision could come true. The book provides an overview and in-depth analysis of a vital debate. It describes how the present policy framework with 2020-targets for the share of renewables, for increase of energy efficiency and for greenhouse gas emissions reduction was developed and how it has been implemented so far. Furthermore, it describes and analyses the emerging debate about the future of our energy system and the necessary next steps and targets leading up to 2030.

This book analyses the case-law of the European Court of Justice on free movement in the energy sector. Sirja-Leena Penttinen provides a comprehensive review of the interpretation and application of the free movement provisions in the energy sector by the European Court of Justice (ECJ), which allow for cross-border energy trade (free movement of goods) and energy investments (free movement of capital). Through detailed analysis of ECJ case-law, Penttinen tracks the development of the legislative framework at EU level in response to the growth of the energy sector, as well as exposing the various political and economic nuances at play. In addition, she sheds light on the dynamic relationship between the EU Member States and their regulatory autonomy, the EU legislator, the Commission and the Court in the establishment of the EU internal energy market. Taking a coherent, systematic approach, this volume will be of great interest to scholars of EU law and energy policy, as well as policymakers and professionals working in this sector.
