Eurojust, the European Union Agency for Criminal Justice Cooperation, is a unique hub based in The Hague, the Netherlands, where national judicial authorities work closely together to fight serious organised cross-border crime. The role of Eurojust is to help make Europe a safer place by coordinating the work of national authorities - from the EU Member States as well as third States - in investigating and prosecuting transnational crime. Each participating EU Member State seconds a National Member to Eurojust. The National Members form the College of Eurojust, which is responsible for the Agency's operational work. The College, in turn, is supported by the Eurojust Administration, which includes, among others, case analysts, legal advisors and data experts. The Agency's custom-built premises provide secure meeting facilities with possibilities for interpretation into all EU languages and a meeting room specifically developed for coordination centres, from which joint action days can be monitored and coordinated in real time. Eurojust has developed a cohesive international network that grants prosecutors around the European Union access to more than 50 jurisdictions worldwide. The Agency has signed cooperation agreements with a dozen non-EU states, several of which have seconded Liaison Prosecutors to Eurojust to work on cases with their counterparts in the College. Eurojust also works closely with other EU agencies and partners that support the various stages in the criminal justice chain, including law enforcement and anti-fraud bodies.

Our main goal is and will always be to meet Member States' requests for practical assistance - ranging from rapid responses to complex, coordinated operations stretching over several years. To strengthen our operational effectiveness, we will increasingly join forces with other JHA agencies and bodies, including the EPPO, Europol, OLAF and FRONTEX. As many of the cases we support extend far beyond the borders of the EU, we will keep expanding our partnerships with third countries and international organisations while working closely together with the Commission on implementing our four-year external cooperation strategy.

At Eurojust, the European Union's Agency for Criminal Justice Cooperation, national judicial authorities from the EU and beyond work together under one roof to fight serious, cross-border crimes and bring perpetrators to justice. In its nearly 20 years of existence, Eurojust has become a unique hub for practical and effective cooperation. In 2019, we supported almost 8 000 cross-border criminal investigations and helped maximize the use of EU judicial cooperation tools. Many investigations extended far beyond EU borders and involved close cooperation with other EU agencies to ensure that information was shared and links were detected between ongoing criminal cases. Eurojust's Single Programming Document 2021-2023 reflects our relentless commitment to continue being the leading partner in bringing criminals to justice and a key player in ensuring a more secure world. Transfers of proceedings constitute a specific form of judicial cooperation that allows national authorities to overcome issues related to concurrent jurisdictions and multiple criminal proceedings, especially in relation to cross-border crime, in the interest not only of the effectiveness of justice but also of the fundamental rights of the suspect/accused. In the absence of a specific EU instrument regulating transfers of proceedings, Member States currently recur to a plurality of legal bases for this purpose, which results in different conditions and procedures being observed in each case. The aim of this report is to inform practitioners and policymakers of the main challenges encountered in Eurojust casework on transfer of proceedings and to highlight the role that Eurojust has played in overcoming such issues. The report is based on the replies to a questionnaire circulated among the Eurojust National Desks, the analysis of cases registered at Eurojust between 2019 and 2021, and is complemented by the findings of the previous documents published by Eurojust on this topic. The report clearly indicates that the current fragmented legal framework leads to several legal issues and difficulties in practice, often making transfers of proceedings to another Member State a cumbersome and not always successful procedure. In Eurojust casework, solutions and best practices were identified, but the report also underlines a number of challenges that practitioners and policymakers should be made aware of.

Drug trafficking remains a highly lucrative market worldwide, with an estimated value of EUR 30 billion per year in the European Union alone. The overall impact on societies has dramatic consequences - for healthcare, governance, economics and other indirectly affected areas. This impact also affects law enforcement and judicial authorities, which find themselves overwhelmed by the steep increase of drug trafficking cases. Many EU Member States struggle to allocate sufficient resources to the fight against highly flexible organised crime groups acting across borders. In addition, organised criminal networks operating in Europe benefit from open borders and take advantage of the complexity of the many different legal frameworks in the EU. To effectively counteract these circumstances, judicial authorities in and outside the EU successfully cooperate - with support from the European Union Agency for Criminal Justice Cooperation (Eurojust). A further rise in the number of referrals to Eurojust can be expected in the coming years and should be taken into account in planning. This report looks at experiences and challenges in judicial cooperation on the fight against drug trafficking.

The Directive on the European Investigation Order (EIO DIR) was introduced to replace and improve the legal framework of mutual legal assistance (MLA). In many cases, the existence of standard forms (available in all EU languages), the increased role of judicial authorities (as issuing or validating authorities), the limited grounds for refusal and the time limits proved successful and had a positive impact on judicial cooperation. Yet, for the mutual recognition formula to be fully successful, it is crucial that the templates be duly filled in, the grounds for non-recognition be applied correctly and time limits be fully respected. This has not always been the case and, in practice, many practitioners have often struggled with the practical application of this instrument. The aim of this report, which is complementary to previously published documents by Eurojust (and the European Judicial Network (EJN)), is to inform both practitioners and policymakers of the main difficulties encountered in the practical application of the European Investigation Order (EIO) on the basis of Eurojust's casework and to highlight, where relevant, the role that Eurojust has played in overcoming such difficulties. The report is primarily based on the analysis of cases addressing issues related to the EIO registered at Eurojust between May 2017 and May 2019, and is complemented by views expressed during dedicated discussions with some Eurojust National Desks. The report clearly indicates that the EIO is not yet functioning as a well-oiled machine. There are still several ongoing issues encountered throughout the life cycle of the EIO. Eurojust has played an important role in facilitating cooperation and ensuring coordination in both bilateral and multilateral cases involving EIOs. In the vast majority of cases handled by Eurojust, the issues mentioned throughout the report were resolved and EIOs could be executed successfully.
