Drug trafficking remains a highly lucrative market worldwide, with an estimated value of EUR 30 billion per year in the European Union alone. The overall impact on societies has dramatic consequences - for healthcare, governance, economics and other indirectly affected areas. This impact also affects law enforcement and judicial authorities, which find themselves overwhelmed by the steep increase of drug trafficking cases. Many EU Member States struggle to allocate sufficient resources to the fight against highly flexible organised crime groups acting across borders. In addition, organised criminal networks operating in Europe benefit from open borders and take advantage of the complexity of the many different legal frameworks in the EU. To effectively counteract these circumstances, judicial authorities in and outside the EU successfully cooperate - with support from the European Union Agency for Criminal Justice Cooperation (Eurojust). A further rise in the number of referrals to Eurojust can be expected in the coming years and should be taken into account in planning. This report looks at experiences and challenges in judicial cooperation on the fight against drug trafficking.

Purpose and objectives The purpose of this Implementation Report of the Action Plan on Drug Trafficking ("Report") is to assess the follow-up of the recommendations listed in the Action Plan as a result of the strategic project Enhancing the work of Eurojust in drug trafficking cases (Eurojust: 2012, page 61).1 The Report also identifies areas where greater efforts are needed and provides suggestions for possible future improvement. A preliminary version of the Report was presented in January 2014 to the College of Eurojust, which decided to integrate this quantitative assessment with an in-depth analysis of three areas where more substantial work was deemed necessary to fully achieve the objectives of the Action Plan. The results of this analysis are now included in three addenda to this Report (entitled Issues in focus), concentrating on judicial issues related to: controlled deliveries, (pre)precursors and New Psychoactive Substances (NPS), and cooperation with third States. The three Issues in focus provided a starting point for discussions at the strategic meeting on drug trafficking held by Eurojust on 29 and 30 September 2014 in The Hague. The preliminary results of the analysis were refined in light of feedback received from the participants of this meeting.

This report collects the results of the "Strategic Project on enhancing the work of Eurojust in drug trafficking cases". A primary goal of the project, covering the two-year period 1 September 2008 to 30 August 2010, was to identify the main challenges and related solutions in Eurojust coordination meetings involving drug trafficking. A second objective was to prepare the workshops for the "Strategic Seminar on Drug Trafficking", which took place in Krakow, Poland, on 5 and 6 October 2011. A third objective was to provide a sound basis for an Action Plan with recommendations on how to enhance Eurojust‟s work with national authorities and third States (see Appendix III of the report).

The strategic meeting on drug trafficking, organised by Eurojust, was held in The Hague on 29 and 30 September 2014. In total, 80 prosecutors, law enforcement authorities and experts in the drug trafficking field from across the Member States of the European Union met at Eurojust's premises for two days of intensive workshops and discussions. Contributions were also received from representatives of Brazil, the USA and Norway, as well as EU bodies and international organisations, including Europol, the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA), the Council of Europe (Pompidou Group) and the United Nations Office on Drugs and Crime (UNODC). With a focus on increasing the effectiveness of international judicial cooperation in drug trafficking cases, this strategic meeting followed Eurojust's strategic seminar on drug trafficking held in Krakow in October 2011, together with the Polish Presidency of the EU. The Krakow seminar called for a multi-disciplinary and coordinated response at international level against organised criminal groups (OCGs) involved in the trafficking of drugs. Progress with respect to the drug trafficking action plan for Eurojust was presented, together with areas in which further work is required: controlled deliveries, (pre)precursors and new psychoactive substances (NPS), and cooperation with third States. The three workshops addressed these areas and gave participants the opportunity to discuss, with reference to case scenarios, pressing issues face-to-face and in-depth. Prior to the strategic meeting, Eurojust circulated two questionnaires to the Member States: one on controlled deliveries and one on judicial perspectives on NPS and pre-precursors. Based on the replies to the questionnaires, in-depth analysis was carried out. The results of the analysis served as a starting point for discussions.

Cross-border cases of trafficking in human beings (THB) are complex and difficult to investigate and prosecute. They reveal the prominent role of organised criminal groups. When gaps in judicial cooperation appear it is the victims of THB who suffer. In October 2020, the European Commission noted in its progress report on THB that judicial authorities in the Member States had raised serious concerns about difficulties in judicial cooperation. This report was prepared by the European Union Agency for Criminal Justice Cooperation (Eurojust), with the aim of responding to these concerns. It presents solutions used by the agency when assisting in complex THB cases requiring judicial coordination. The report also aims to inform the forthcoming EU strategy against THB. It expresses Eurojust's readiness to play a central role in the future strategy, by bringing substantial added value to the operational dimension of combating THB. The final aim of the report is to assist in successfully bringing human traffickers to justice, while protecting the victims. The report is divided into two main parts. The first part relates to the coordination of investigations and the second to victims' rights. The report draws on the practical experience gained from Eurojust's support of human trafficking investigations between 2017 and 2020. In total, 91 cases of THB were selected for analysis by Eurojust's anti-trafficking team, of which 31 are illustrated in this report. Each case highlights the diverse legal and practical problems faced and provides examples of good practice, followed by targeted recommendations. In total, 18 recommendations are made, which supplement the recommendations provided in previous Eurojust reports on THB. These recommendations are mainly aimed at prosecutors, judges and law enforcement authorities.

The year 2017 has been transitional for Eurojust in terms of organisational developments. The upper level of management changed with the appointment of Mr Nikolaos Panagiotopoulos, as Administrative Director, Mr Ladislav Hamran, National Member for the Slovak Republic, as President, and Mr Filippo Spiezia, National Member for Italy, as Vice-President. Messrs Hamran and Spiezia, together with Vice-President Mr Klaus Meyer-Cabri, National Member for Germany, form the Presidency Team. On 30 June, Eurojust moved to its new premises. The transition was managed successfully, ensuring that no loss of operational capacity occurred. The first fully operational working day was 3 July; on 5 July, Eurojust held its first coordination centre at the new premises. Finally, Eurojust implemented an in-depth reorganisation of the Administration, with more resources devoted to reinforcing support to operational work, which has created synergies and efficiency gains. These efficiency gains were exemplified by an outstanding 99.97% rate of budget execution and a payment execution rate of 83.95% for a EUR 48 689 237 budget for 2017. Concerning the core business of the agency, in 2017, Eurojust strengthened its position as the centre for judicial cooperation and coordination in the fight against serious cross-border crime. The number of cases referred to Eurojust continued to rise, with a steady increase in cases registered. In 2017, 4 125 cases were handled, 2 550 of which were newly opened, representing a 10.55% increase compared to 2016. The number of coordination meetings increased by 21% and the number of coordination centres increased by 70%, respectively, when compared to 2016. In addition, Eurojust supported 200 JITs, 87 of which were newly signed, and provided funds to support the operations of such JITs for EUR 1.31 million. These figures show Eurojust’s dynamic and quality judicial coordination support to national authorities. As the centre of judicial and legal expertise in the European Union, Eurojust continued to provide advice and produce relevant strategic products based on its operational experience in judicial cooperation in criminal matters. In 2017, Eurojust provided advice to national authorities in executing European Investigation Orders in criminal matters (EIO), a new instrument that entered into force on 22 May. During the year, Eurojust assisted the national authorities with the application of the EIO on 86 occasions and provided legal advice in operational cases when encountering difficulties. Eurojust will continue monitoring and analysing potential problems that may arise. In addition, the College held 33 operational meetings devoted to both operational discussions and adoption of strategic products and other tools for practitioners and policymakers. Eurojust held 38 strategic meetings and strategic seminars and delivered strategic reports, contributing to enhancement of, and identifying best practice in, international judicial cooperation. Eurojust produced judicial monitors on terrorism and on cybercrime, the Fifth Foreign Fighters Report, a drug trafficking report and the Trafficking in Human Beings Report. Cooperation with stakeholders and partners in the EU Area of Freedom, Security and Justice was also enhanced by the support to the activities of the European Judicial Cybercrime Network (EJCN) and the 12th Consultative Forum meeting. Eurojust supported the EU internal security initiatives by contributing to the EU Terrorism Situation and Trend Report (TE-SAT); and through its involvement in the EU policy cycle against organised crime through the activities carried out in all priority crime areas within the Multidisciplinary Platform against Criminal Threats (EMPACT). Furthermore, Eurojust signed a Memorandum of Understanding with EU-LISA and a Letter of Understanding with the European External Action Service.

Trafficking in human beings (THB) is a serious crime, often committed by organised criminal groups and involving severe violations of fundamental human rights and exploitation of victims. THB represents one of the main threats to the internal security of the European Union and the freedom of its citizens. Eurojust plays a key role in the fight against human trafficking, which has been, and remains, high on the EU agenda as one of the eight priorities in the fight against organised crime between 2011 and 2013. However, statistics show that the number of THB prosecutions and the number of THB cases referred to Eurojust for assistance remains low. Together with Europol and other JHA agencies, Eurojust signed in October 2011, on the occasion of the 5th EU Anti-Trafficking Day, a Joint Statement to address THB in a coordinated, coherent and comprehensive manner. The joint effort includes assistance to Member States to increase the number of THB investigations and prosecutions and to coordinate cross-border action, so that human traffickers are brought to justice efficiently. In this context, Eurojust took the initiative in 2012 to develop a strategic project entitled Eurojust's action against trafficking in human beings. This report summarises the project's findings by attempting to answer the following questions: What are the reasons underlying such a small number of THB prosecutions and such limited involvement of Eurojust in THB cases? What can Eurojust do to improve the situation? This report also highlights the main problems encountered by the national authorities in prosecuting THB and attempts to present solutions for addressing these difficulties.
