Das europaische Recht des Geistigen Eigentums hat einen Harmonisierungsstand erreicht, der seinesgleichen in anderen Rechtsgebieten sucht und zu einer Vielzahl aktueller Reformperspektiven und Fragestellungen fuhrt. In diesem Zusammenhang wendete sich das in diesem von Matthias Leistner herausgegebenen Band dokumentierte Bonner Symposion zu aEuropaischen Perspektiven des Geistigen Eigentums bewusst ausgewahlten Problemkreisen zu, die uber ihre tagesaktuelle Relevanz hinaus bestimmte grundlegende Problemzonen umreissen, in denen das Recht des Geistigen Eigentums traditionellen Zuschnitts unubersehbar an seine Grenzen gerat. Im Patentrecht wird mit Beitragen von Ascheid und Ullrich die aktuelle Problematik standardisierungsrelevanter Patente (insbesondere im Mobilfunkbereich) aufgegriffen. Daneben steht die europaische Entwicklungsperspektive im Urheberrecht besonders im Mittelpunkt: Aspekte der kollektiven Rechtewahrnehmung und nationaler Vergutungsregelungen in Europa werden ebenso thematisiert ( Hilty ) wie die hiermit verbundene Problematik neuer Perspektiven im Bereich der Schrankenregelungen ( Metzger ) auf europaischer Ebene. Schliesslich wird auch die grundlegende Fragestellung nach der Notwendigkeit eines einheitlichen europaischen Urheberrechtstitels aufgeworfen ( Schack ). Daruber hinaus finden sich auch einzelne schutzrechtsubergreifende Aspekte behandelt: So werden die aktuellen Reformperspektiven zur Verantwortlichkeit fur Schutzrechtsverletzungen, insbesondere im Bereich der Providerhaftung, diskutiert ( Haedicke, Spindler ) und schliesslich uber die Moglichkeit und Notwendigkeit einer wissenschaftlichen Initiative zur Entwicklung allgemeiner Prinzipien eines europaischen Rechts des Geistigen Eigentums nachgedacht ( Ohly ).

Zun chst wird einleitend auf die vertragsrechtlichen Grundlagen sowie den institutionellen Rahmen der EU-Ukraine-Beziehungen eingegangen. Des Weiteren werden die Folgen der Verschiebung der EU-Au engrenze Richtung Osten unter besonderer Ber cksichtigung der Erweiterung des Schengen-Raums f r die Bev lkerung auf beiden Seiten dargestellt. Anschlie end wird gepr ft, unter welchen Bedingungen der Ukraine die Mitgliedschaftsperspektive in der EU gew hrt werden kann. Since Bitcoin appeared in 2009, the digital currency has been hailed as an Internet marvel and decried as the preferred transaction vehicle for all manner of criminals. It has left nearly everyone without a computer science degree confused: Just how do you “mine” money from ones and zeros? The answer lies in a technology called blockchain, which can be used for much more than Bitcoin. A general-purpose tool for creating secure, decentralized, peer-to-peer applications, blockchain technology has been compared to the Internet itself in both form and impact. Some have said this tool may change society as we know it. Blockchains are being used to create autonomous computer programs known as “smart contracts,” to expedite payments, to create financial instruments, to organize the exchange of data and information, and to facilitate interactions between humans and machines. The technology could affect governance itself, by supporting new organizational structures that promote more democratic and participatory decision making. Primavera De Filippi and Aaron Wright acknowledge this potential and urge the law to catch up. That is because disintermediation—a blockchain’s greatest asset—subverts critical regulation. By cutting out middlemen, such as large online operators and multinational corporations, blockchains run the risk of undermining the capacity of governmental authorities to supervise activities in banking, commerce, law, and other vital areas. De Filippi and Wright welcome the new possibilities inherent in blockchains. The development of EU enlargement has raised many thorny issues unanticipated by the framers of the EC Treaty. A significant upshot of these issues is that the concept of European identity – defined in terms of such factors as culture, history and economics – has supplanted the long-dominant theme of ‘widening and deepening,’ particularly since the Union’s expansion has become primarily eastward. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the ‘identity’ conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between ‘widening’ and ‘deepening’ and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity. Also covered are specific historical details of particular pre-accession negotiations (e.g., Greece, Spain, Portugal, Malta, and Cyprus), the still inconclusive negotiations with Turkey and the Western Balkan states, and political factors involved in the non-accession of Norway, Iceland and Switzerland. Assembling powerful evidence and applying incisive analysis, the author’s conclusion shows that, absent further (and major) EU institutional reform, it will be difficult for an enlarging Union to continue to ‘deliver the goods.’ A watershed in the continuing great debate on the fulfilment of the EC Treaty’s determination to foster and promote ‘an ever closer union of the peoples of Europe,’ this book will prove invaluable to anybody interested in the European integration project, particularly lawyers, academics, officials and policymakers in the EU Member States.

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

This book introduces the reader to ethics by examining a current and important debate. During the last fifty years the orthodox position in ethics has been a broadly non-cognitivist one: since there are no moral facts, moral remarks are best understood, not as attempting to describe the world, but as having some other function - such as expressing the attitudes or preferences of the speaker. In recent years this position has been increasingly challenged by moral realists who maintain that there are moral facts; there is a truth of the matter in ethics, which is independent of our views, and which we seek to discover. Unfortunately much of this interesting debate found in the work of McDowell, Wiggins, Putnam, Blackburn and others is not easily accessible to undergraduates. McNaughton presents many of the major issues in ethics by way of a clear exposition of both sides of this argument and assumes no prior knowledge of philosophy. Topics discussed include: moral observation, moral motivation, amoralism and wickedness, moral weakness, cultural relativism and utilitarianism. The book concludes that a convincing case can be made out for a radical form of moral realism in which moral virtue is found, not in the following of correct moral principles, but rather in the development of moral sensitivity.
