Das Buch durchdenkt verschiedene Modelle einer engeren Einbindung der EU im IWF und zeigt auf, ob und inwieweit sich einzelne Vorschläge und Ansätze vor dem Hintergrund des geltenden Völkervertragsrechts und der Interessenlage der IWF-Mitgliedstaaten umsetzen lassen.Im Zuge der seit 2009 virulenten Staatsschuldenkrise ist der Internationale Währungsfonds (IWF) in die sogenannten Rettungsschirme und Stabilisierungsmechanismen eingespannt worden. Aus diesem Anlass ist erneut klar geworden, dass die EU im Gefüge des IWF keinen definierten Status hat, obwohl der Euro in dessen sogenanntem Währungskorb an die Stelle des französischen Franc und der D-Mark getreten ist. Die ausschließliche Zuständigkeit der EU für die Währungspolitik der Mitgliedstaaten, deren Währung der Euro ist, wirft die Frage auf, ob sie nicht wie in anderen internationalen Organisationen auch Mitglied des IWF werden müsste. Dem stehen indessen komplexe rechtliche und politische Hindernisse im Wege.

Dieses Buch ist in drei Kapitel unterteilt und behandelt dabei unter anderem zwei Themen, die seit dem Beginn der Krise im Jahr 2007/2008 in den Medien schon so oft diskutiert und breitgetreten wurden, dass die Reaktionen der Bevölkerung alles von Resignation über Verunsicherung bis hin zu Wut beinhalten. Diese Themen sind der Euro und der US-Dollar als Leitwährung. In den Medien wird immer wieder von einer Euro-Krise berichtet, doch von wem geht diese Aussage aus? Befinden wir uns wirklich in einer Euro-Krise? Dass es nicht ganz so einfach ist, wird in diesem Buch aufgezeigt. Deshalb werden einerseits verschiedene Gründe für die derzeitige Krise und andererseits gesetzte Maßnahmen der Europäischen Union, um ein erneutes Aufkommen einer Krise zu verhindern, erörtert. Fragen, die in diesem Zusammenhang aufgeworfen und beantwortet werden, sind folgende: Befinden wir uns in einer Fiskalkrise? Handelt es sich um einen Fehler des Integrationsprozesses? Befinden wir uns in einer Krise des Finanzmarktkapitalismus? Welchen Einfluss hat die Finanzoligarchie? Entwickeln wir uns in Richtung einer Transferunion? Das zweite Hauptthema ist dem US-Dollar als Leitwährung und somit der Weltwährungsordnung gewidmet. Hierbei werden sowohl Euro und Dollar, Europäische Zentralbank und Federal Reserve System als auch Internationaler Währungsfonds und Europäischer Währungsfonds gegenübergestellt. Des Weiteren werden Gründe für das Halten und den rapiden Anstieg von Währungsreserven aufgezeigt. Auch pro und contra von festen und flexiblen Wechselkursen werden diskutiert. Im Zusammenhang mit der Weltwährungsordnung werden ebenfalls die Sonderziehungsrechte und der wieder neu aufgegriffenen Idee Keynes‘ International Clearing Union und der fiktiven Währung Bancor beschrieben. Das Erste dieser eingangs erwähnten drei Kapitel ist die Geschichte des Finanzsystems. Dieses erläutert die Hintergründe und Handlungsweisen des Goldstandards und des Währungssystems von Bretton Woods. Es werden zusätzlich noch Ideen und Gedanken der Klassik, der Neoklassik und des Keynesianismus vorgestellt. Der Leserin / dem Leser dieses Buches werden neue Sichtweisen auf die Europäische Union, den Euro und den US-Dollar veranschaulicht.

International courts and other actors are increasingly taking into account pre-existing social structures and inequalities when addressing and redressing human rights violations, in particular discrimination against specific groups. To date, however, academic legal research has paid little attention to this gentle turn in international human rights law and practice to address structural discrimination. In order to address this gap, this study analyses whether and to what extent international and regional human rights frameworks foresee positive obligations for State parties to address structural discrimination, and, more precisely, gender hierarchies and stereotypes as root causes of gender-based violence. In order to answer this question, the book analyses whether or not international human rights law requires pursuing a root-cause-sensitive and transformative approach to structural discrimination against women in general and to the prevention, protection and reparation of violence against women in particular; to what extent international courts and (quasi)judicial bodies address State responsibility for the systemic occurrence of violence against women and its underlying root causes; whether or not international courts and monitoring bodies have suitable tools for addressing structural discrimination within the society of a contracting party; and the limits to a transformative approach.

This book discusses the relationship between democracy and the financial order from various legal perspectives. Each of the nine contributions adopts a unique perspective on the legal and political challenges brought to the fore by the Global Financial Crisis. This crisis and the ensuing sovereign debt crisis in Europe are only the latest in a long series of financial crises around the globe in recent decades. By their very existence, but also as a result of the political turmoil they have created, these financial crises testify to the well-known tensions between democracy and a market-based economic and financial order. However, what is missing in this debate is an analysis of the role of law for reconciling democracy with a market-based financial order. To fill this lacuna, the book focuses on the controversy surrounding the concept of law, thereby adding another variable to the debate on the relation between democracy and capitalism.
