This book traces the academic footprint of Hanns Ullrich. Thirty contributions revolve around five central topics of his oeuvre: the European legal order, competition law, intellectual property, the regulation of new technologies, and the global market order. Acknowledging him as a trailblazer, the book aims to capture how deeply Hanns Ullrich has influenced contemporaries and subsequent generations of scholars. The contributors re-iterate the path-breaking patterns of his teachings, such as his contemplation of intellectual property as embedded in competition, the necessity of balancing private and public interests in intellectual property law, the policies of market integration, and the peculiar relationship of technological advancement and protectionism.

Dieter Grimm is one of the foremost scholars of constitutional law, constitutional theory, and European law in Germany and worldwide. His jurisprudential writings have found a large English-language audience in works such as Constitutionalism: Past, Present, and Future and The Constitution of European Democracy. This book is a conversation between Grimm and three scholars of constitutional law - Oliver Lepsius, Christian Waldhoff, and Matthias Rossbach - on his background, his childhood under the Nazi regime and the ruins of post-war Germany, his education in Germany, France, and the United States, his academic achievements, the main subjects of his research, his experience as a judge on a leading constitutional court (especially in the time of pivotal changes in the world after the fall of the Berlin Wall), and his views on actual challenges for law and society. Grimm also speaks about his attitude toward European integration where he is best known for his thesis that one of the biggest but least noticed causes for the lack of democratic legitimacy of the EU is its 'over-constitutionalization'. The book is an invaluable source of information on an outstanding career and the functioning of constitutional adjudication that the reader would not find in legal textbooks or treatises. The Times Literary Supplement, reviewing the German edition, stated: "For anyone wishing to understand the respect for the rule of law in modern Germany, this book is highly recommended."

Verfassungsgerichtsbarkeit Und Demokratie written by Tamara Ehs and has been published by Böhlau Verlag Wien this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-02-13 with History categories.

Roller Coaster written by Ian Kershaw and has been published by Penguin UK this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-08-30 with History categories.

From one of Britain's most distinguished historians and the bestselling author of Hitler, this is the definitive history of a divided Europe, from the aftermath of the Second World War to the present. After the overwhelming horrors of the first half of the 20th century, described by Ian Kershaw in his previous book as having gone 'to Hell and back', the years from 1950 to 2017 brought peace and relative prosperity to most of Europe. Enormous economic improvements transformed the continent. The catastrophic era of the world wars receded into an ever more distant past, though its long shadow continued to shape mentalities. Europe was now a divided continent, living under the nuclear threat in a period intermittently fraught with anxiety. Europeans experienced a 'roller-coaster ride', both in the sense that they were flung through a series of events which threatened disaster, but also in that they were no longer in charge of their own destinies: for much of the period the USA and USSR effectively reduced Europeans to helpless figures whose fates were dictated to them by the Cold War. There were striking successes - the Soviet bloc melted away, dictatorships vanished and Germany was successfully reunited. But accelerating globalization brought new fragilities. The impact of interlocking crises after 2008 was the clearest warning to Europeans that there was no guarantee of peace and stability. In this remarkable book, Ian Kershaw has created a grand panorama of the world we live in and where it came from. Drawing on examples from all across the continent, Roller-Coaster will make us all rethink Europe and what it means to be European.

This book explores the sheer complexity of the SSM’s institutional design adopting an comprehensive approach to banking supervision. At its core, this work examines the tangible mechanisms of prudential regulation or supervision both at the European and national levels, offering a comparative analysis of ten national systems. Reflecting the results of an intensive, four-year research project that saw the collaboration of academics and practitioners, it addresses two interrelated issues. It investigates the efficacy of the shared national- and EU-level enforcement system the EU introduced in reaction to the financial and banking crisis.Secondly, it scrutinizes the role that criminal law can play in sanctioning the breaches to banking regulation.

Critique Of Freedom written by Otfried Höffe and has been published by University of Chicago Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-12-08 with Philosophy categories.

In this ambitious book, philosopher Otfried Höffe provides a sophisticated account of the principle of freedom and its role in the project of modernity. Höffe addresses a set of complex questions concerning the possibility of political justice and equity in the modern world, the destruction of nature, the dissolving of social cohesion, and the deregulation of uncontrollable markets. Through these considerations, he shows how the idea of freedom is central to modernity, and he assesses freedom’s influence in a number of cultural dimensions, including the natural, economic and social, artistic and scientific, political, ethical, and personal-metaphysical. Neither rejecting nor defending freedom and modernity, he instead explores both from a Kantian point of view, looking closely at the facets of freedom’s role and the fundamental position it has taken at the heart of modern life. Expanding beyond traditional philosophy, Critique of Freedom develops the building blocks of a critical theory of technology, environmental protection, economics, politics, medicine, and education. With a sophisticated yet straightforward style, Höffe draws on a range of disciplines in order to clearly distinguish and appreciate the many meanings of freedom and the indispensable role they play in liberal society.

The Concept Of Liberal Democratic Law written by Johan van Der Walt and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-09-12 with History categories.

This book develops a historical concept of liberal democratic law through readings of the pivotal twentieth century legal theoretical positions articulated in the work of Herbert Hart, Ronald Dworkin, Duncan Kennedy, Rudolf Smend, Hans Kelsen and Carl Schmitt. It assesses the jurisprudential projects and positions of these theorists against the background of a long history of European metaphysics from which the modern concept of liberal democratic law emerged. Two key narratives are central to this history of European political and legal metaphysics. Both concern the historical development of the concept of nomos that emerged in early Greek legal and political thought. The first concerns the history of philosophical reflection on the epistemological and ontological status of legal concepts that runs from Plato to Hobbes (the realist-nominalist debate as it became known later). The second concerns the history of philosophical and political discourses on law, sovereignty and justice that starts with the nomos-physis debate in fifth century Athens and runs through medieval, modern and twentieth century conceptualisations of the relationship between law and power. Methodologically, the reading of the legal theoretical positions of Hart, Dworkin, Kennedy, Smend, Kelsen and Schmitt articulated in this book is presented as a distillation process that extracts the pure elements of liberal democratic law from the metaphysical narratives that not only cradled it, but also smothered and distorted its essential aspirations. Drawing together key insights from across the fields of jurisprudence and philosophy, this book offers an important and original re-articulation of the concept of democratic law.

Ever Closer Union written by Perry Anderson and has been published by Verso Books this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-09-28 with Political Science categories.

A comprehensive, critical assessment of the EU after Brexit The European Union is a political order of peculiar stamp and continental scope, its polity of 446 million the third largest on the planet, though with famously little purchase on the conduct of its representatives. Sixty years after the founding treaty, what sort of structure has crystallised, and does the promise of ever closer union still obtain? Against the self-image of the bloc, Perry Anderson poses the historical record of its assembly. He traces the wider arc of European history, from First World War to Eurozone crisis, the hegemony of Versailles to that of Maastricht, and casts the work of the EU’s leading contemporary analysts – both independent critics and court philosophers – in older traditions of political thought. Are there likenesses to the age of Metternich, lessons in statecraft from that of Machiavelli? An excursus on the UK’s jarring departure from the Union considers the responses it has met with inside the country’s intelligentsia, from the contrite to the incandescent. How do Brussels and Westminster compare as constitutional forms? Differently put, which could be said to be worse?
