Studienarbeit aus dem Jahr 2007 im Fachbereich Politik - Internationale Politik - Thema: Europäische Union, Note: 1,0, Universität Mannheim, 11 Quellen im Literaturverzeichnis, Sprache: Deutsch, Abstract: Bei den Volksabstimmungen am 29.05.2005 in Frankreich und am 01.06.2005 in den Niederlanden sprachen sich deren Bürger gegen die Europäische Verfassung aus und versetzten dem Europäischen Integrationsprozess so einen erheblichen Rückschlag. In Deutschland stimmte der Bundestag am 12.05.2005 und der Bundesrat am 27.05.2005 zwar dem Verfassungsvertrag zu, wegen der Ablehnung in der Bevölkerung und den desaströsen Ergebnissen in Frankreich und den Niederlanden entschied sich Bundespräsident Horst Köhler jedoch, den Vertrag nicht zu ratifizieren. Gerade wegen der Vorbehalte bei den deutschen Bürgern muss die Zuständigkeit von Parlament und Bundespräsident genau untersucht werden. Ist die Europäische Verfassung nämlich eine Verfassung im Sinne des Grundgesetzes, überträgt dessen Artikel 146 diese Entscheidung an eine Volksabstimmung und es verliert seine Gültigkeit erst "an dem Tage, an dem eine Verfassung in Kraft tritt, die von dem deutschen Volke in freier Entscheidung beschlossen worden ist."

Die Integration Europas bleibt für die Sozialwissenschaften eine Quelle der Inspiration und Herausforderung. Auch 53 Jahre nach Unterzeichnung der Römischen Verträge ist der Kontinent weiter in Bewegung, geht es um die Vision seiner zukünftigen Gestalt ebenso wie um die Regelung vielfältigster Tagesprobleme. Um zu dieser Debatte einen spezifischen Beitrag zu leisten, fand im Juni 2010 an der Universität Potsdam eine deutsch-polnische Konferenz zum Thema „Europa als Inspiration und Herausforderung aus sozialwissenschaftlicher Sicht“ statt. Dabei wurden unterschiedliche Ansätze der europawissenschaftlichen Forschungen in den beteiligten Einrichtungen (z. B. aus der Sicht von Politologen, Soziologen, Historikern oder Kulturwissenschaftlern) präsentiert. Zugleich diente die Konferenz dazu, das wissenschaftliche Forschungsinteresse am „nahen Osten“ wieder zu stärken.

Thomas Muller geht eine der grundlegendsten europaischen Rechts- bzw Verfassungsfragen an: Welche Rolle spielt der wirtschaftliche Wettbewerb im Unionsrecht? Diese Fragestellung ist angesichts der aktuellen sozialen und krisenpolitischen Herausforderungen in der Europaischen Union brisant. Auf Basis einer prinzipienorientierten Theorie und einer aktuellen Dogmatik der europaischen Wettbewerbsverfassung analysiert der Autor die EuGH-Rechtsprechung und Anwendungspraxis der Kommission.
