European Union boundaries have always been unusual. In no other political community is both the prospect of enlargement and the ever-present possibility of withdrawal part of the constitutional framework. We find few other instances where some territories in a political community adopt a common currency while others do not. Examples of thick association agreements, such as we find between the EU and third countries like Switzerland and Norway, are uncommon. Over the last number of years, EU boundaries have been challenged like never before. Brexit poses a fundamental threat to the EU’s territorial integrity and the rights of EU citizens to cross what have been regarded as open borders; the refugee crisis and the increase of terrorism both call into question the EU’s ability to justly and effectively manage its external borders; the rise of populism is a direct challenge to internal free movement as the demand to reassert national borders becomes formidable; while the aftermath of the euro-crisis continues to put Monetary Union in doubt. By distinguishing between three categories of boundary change – boundary-making, boundary-crossing and boundary-unbundling – the authors in this volume attempt to shed light on the sustainability and legitimacy of Europe’s boundaries in question. The chapters originally published as a special issue in the Journal of European Integration.

European private international law is by now based mainly on a large body of uniform rules such as the Regulations Rome I, Rome II, Brussels I, Brussels I bis. This significant legislative output, however, does not take place in a vacuum. Rules of private international law have been earlier (and still are) adopted at national, international and even European level in scattered regulations and directives. The recent plethora of private international law rules gives rise to issues of delineation and calls for some sort of ordering as gaps, overlaps and contradictions become flagrant. At the same time, the resulting interactions can offer new insight, ideas and even opportunities at a more theoretical level. This book gathers a collection of essays resulting out of a series of international seminars held in Lyon, Barcelona and Louvain-la-Neuve. During those seminars, young researchers selected in an open call for papers had the opportunity to discuss their views among themselves as well as with various specialists of the field, such as more senior academics, EU civil servants, national experts and representatives of other international organisations. The book offers the fresh views of those who will in the future shape the dialectic between the various sources of private international law and attempts to launch a discussion on the “living together” of legal sources. Two ranges of topics are addressed in the book: - firstly, the relationship between EU private international law and national law (substantial and procedural) and/or international law (international instruments of private international law or of uniform substantive law); and - secondly, the relationship between EU private international law and other aspects of EU law (internal market rules of primary law, harmonisation through secondary law and other pieces of legislation enacted in the realm of the area of freedom, security and justice).

African Migrants, European Borders, and the Problem with Humanitarianism presents a probing examination of the contemporary migrant “crisis” in the Mediterranean Basin. By centering our analysis on how racial slavery has shaped European democratic culture, its abolitionist traditions, and the global structures of capital accumulation, P. Khalil Saucier and Tryon P. Woods reveal and confront how contemporary discourse on the migrant “crisis” displaces Black sovereign mobility. Their inquiry into the modern world’s culture of politics investigates “freedom of movement” discourse’s ostensible confrontation with border policing, the memorializing of Black migrant deaths by artists and advocates, and the visual imagery of a cosmopolitan and multicultural Europe as conceived by filmmakers in response to the migrant “crisis” as variants of a slaveholding culture instantiated in the early Mediterranean and Atlantic worlds. This analysis allows the authors to formulate a new critical framework for analysis of both the problems of contemporary migration and borders and the leading prescriptions on offer from analysts, advocates, and policy makers in order to develop alternate ways of conceptualizing global society.

This book seeks to answer the question 'Which institutional architecture for which kind of democracy for the EU?' by bringing two important recent debates together- the institutional analysis of the Union and its democratic assessment. The book examines a series of institutional architectures in light of the democratic quality of the processes and decisions generated by them. The discussion of these various institutional architectures is preceded by an analysis of the democratic values and principles according to which institutional architectures and governance structures should be assessed. The first part of the volume starts from key democratic principles and indicates which institutional architectures are most likely to embody them. The second part is dedicated to those institutional architectures that best describe the current state of the European Union and its likely future development, particularly given the impact of the current economic crisis. The fundamental belief that animates this volume is that it is only by paying attention to the democratic legitimacy of the Union that the process of European integration may hope to be sustainable, particularly in the face of the difficult economic crisis that the members of the Euro-area and the Union in general are experiencing.
