Each year the Government deposits 1200 European policy documents for scrutiny, some of which are cleared straight away, whilst others are reserved for further scrutiny. This volume offers an evaluation of the Schengen Information System and border control co-operation from a transparency and proportionality perspective. It also incorporates a legal descriptive analysis of the co-operation in order to accommodate the changes and developments that occurred during the writing period. The transparency and proportionality perspectives are developed from human rights and data protection criteria. Transparency is understood as knowledge and accessibility to legal information as well as openness and accountability. On the other hand, proportionality is a requirement for guidance, balance and justification as well as a need to avoid excessiveness and arbitrariness in border control work. The final findings reveal that the Schengen co-operation suffers from a deficiency of transparency and proportionality. Consequently, measures are proposed to augment the deficiency. Even as this study was reaching its conclusion, fundamental legislative changes, closely similar to some of the arguments and recommendations projected in this study, took place. The efficacy of these changes is yet to be discerned.

This book examines the processes and factors shaping the development of homeland security policies in the European Union (EU), within the wider context of European integration. The EU functions in a complex security environment, with perceived security threats from Islamist terrorists, migration and border security issues, and environmental problems. Eurojust (the EU Judicial Co-operation Unit) was established by a Council Decision in February 2002 to facilitate judicial co-operation in criminal matters within the EU. It comprises a group of full-time judges and prosecutors, one from each of the 25 EU member states, who assist national authorities in investigation and prosecuting serious cross-border crime, such as terrorism, drug trafficking, money laundering and trafficking in human beings. The Committees report finds that Eurojust has proved itself to be a highly effective means of facilitating co-operation in these matters, and notes that the Office of the European Public Prosecutor (to be established in due course) should build on its approach. Five key recommendations are made to further enhance the effectiveness of Eurojust including the need for data protection rules and for closer co-operation with Europol and the European Anti-Fraud Office (OLAF).
