Exposing the powerful contradictions between empowering rights and legal rites By investigating the harms routinely experienced by the victims and survivors of domestic violence, both inside and outside of law, Everyday Harm studies the limits of what domestic violence law can--and cannot--accomplish. Combining detailed ethnographic research and theoretical analysis, Mindie Lazarus-Black illustrates the ways persistent cultural norms and ingrained bureaucratic procedures work to unravel laws designed to protect the safety of society's most vulnerable people. Lazarus-Black's fieldwork in Trinidad traces a story with global implications about why and when people gain the right to ask the court for protection from violence, and what happens when they pursue those rights in court. Criminologists are primarily concerned with the analysis of actions that violate existing laws. But a growing number have begun analyzing crimes as actions that inflict harm, regardless of the applicability of legal sanctions. Even as they question standard definitions of crime as law-breaking, scholars of crime have few theoretical frameworks with which to understand the etiology of harmful action. In Why We Harm, Lois Presser scrutinizes accounts of acts as diverse as genocide, environmental degradation, war, torture, terrorism, homicide, rape, and meat-eating in order to develop an original theoretical framework with which to consider harmful actions and their causes. In doing so, this timely book presents a general theory of harm, revealing the commonalities between actions that impose suffering and cause destruction. Harm is built on stories in which the targets of harm are reduced to one-dimensional characters—sometimes a dangerous foe, sometimes much more benign, but still a projection of our own concerns and interests. In our stories of harm, we are licensed to do the harmful deed and, at the same time, are powerless to act differently. Chapter by chapter, Presser examines statements made by perpetrators of a wide variety of harmful actions. Appearing vastly different from one another at first glance, Presser identifies the logics they share that motivate, legitimize, and sustain them. From that point, she maps out strategies for reducing harm.

This book explores how neoliberal consumer capitalist ideals of meritocracy, competitive individualism, and responsibilisation have shaped trans people’s subjectivity and lived experiences of harm. The book critiques the adequacy of legal constructs of hate crime to acknowledge the social harms experienced. The deep ethnographic data illuminates a variety of social harms that result from the failure of social structures and systems to acknowledge gender identities beyond the binary. The book offers a historically grounded theorisation of anti-trans sentiment to produce a persuasive argument for understanding the harms of hate as recognitive harms. In this sense, the book opens up a path to theorizing the empirically documented emotional and psychological harms of both transphobia and transnormative ideals, as rooted in a binary gender order that has been invigorated by the hyper individualism and competitiveness of capitalist neoliberalism.

A harrowing look at violence among Argentina's urban poor Arquitecto Tucci, a neighborhood in Buenos Aires, is a place where crushing poverty and violent crime are everyday realities.
