¿Qué le lleva al legislador a incorporar al Código Penal la pena de prisión permanente revisable? ¿Qué le lleva a castigar con cuatro años de prisión el hecho de abandonarel lugar de un accidente, existiendo ya el delito de omisión del deber de socorro? ¿Qué le lleva a convertir en delito las relaciones sexuales consentidas entre adolescentes? La respuesta nos la ofrece el propio legislador. En su opinión, la sociedad lo demanda. Sin embargo, esa demanda social no ha sido probada, y se sorprendería el legislador al saber que la ciudadanía – bien informada – no es tan punitivista como pudiera pensarse. Además,incluso aunque existiera tal demanda social, este no es un argumento válido para legitimar una determina política. ¿Acaso entenderíamos como legítima en un Estado democrático y de Derecho una decisión adoptada por la mayoríaque decidiera restringir derechos de los demás? Es evidente que no. La demanda social es un argumento insostenible para justificar una política criminal. Por eso esta obra pretende erigirse en crítica constructiva al legislador penal, que no puede continuar amparándose en dicho argumento para intensificar, cada vez más, la intervención del Derecho penal. Es el momento de que el legislador, en línea con lo que exige la normativa de la UE, abandone el populismo punitivo y elabore políticas basadas en la evidencia. Solo así se podrá valorar la eficacia de una política y solo así se podrá exigir una rendición de cuentas. En último término, esta obra defiende que la evidencia empírica no puede ser el único argumento para llevar a cabo una política criminal. No sería aceptable, por ejemplo, la asignación de una pena de prisión perpetua para el delito de robo, por mucho que eso hiciera descender el número de esos delitos. El Derecho penal es, y debe seguir siendo, la ultima ratio del Estado. Existen otros mecanismos previos al Derecho penal, menos lesivos con los derechos de los ciudadanos, a los que se puede recurrir. Además, todapolítica criminal encuentrasiempre un límite infranqueable en los principios legitimadores del Derecho penal, hoy con reconocimiento constitucional, que tienen como trasfondo último la dignidad del ser humano. Luego por muy eficaz que pudiera ser una política criminal, no podrá implementarse si la misma vulnera principios como el de legalidad o el de proporcionalidad, o garantías como la presunción de inocencia.
