This book seeks to reimagine why and how to confront mass atrocities in world politics. Drawing on Hannah Arendt’s conception of evil, it interprets and understands mass atrocities as ‘evil’ in an ‘Arendtian’ sense, that is, as crimes against human plurality and, thus, crimes against humanity itself. This understanding of mass atrocities paves the way for reframing responses to mass atrocities as attempts to confront evil. In doing so, the book focuses on military intervention under the banner of the Responsibility to Protect (R2P) and judicial intervention by the International Criminal Court (ICC) and reframes them as tools to protect human plurality from evil. Furthermore, the book looks at the place and the role of R2P and the ICC in the changing landscape of world order. It argues that the protection of humanity from evil can serve as a legitimate Grundnorm (basic norm) around which a global constitutional order in an inherently pluralistic world can be constructed.

Understanding Evil seeks to articulate the evil that happened in Bosnia within the context of war crimes and crimes against humanity. Its analysis centers on the question of whether it is possible to understand evil as action. Since the foundations of the social are found in human action, evil's assault on these foundations results in the demise of the social. While evil simulates the outer form of action, ultimately evil belies itself as action. Can someone act with an evil end? Socrates says no, no one willingly does evil. Although, with a mixture of reason and empiricism, the author tries hard to overcome the Socratic position--searching for evil's agency, purpose, means, conditions, and ethos--in the end, the search fails. The author concludes by accepting the Socratic position: action whose end is evil is unthinkable. This tack provides an alternative to recent theorizing about evil by philosophers such as Richard Bernstein and Jeffrey Alexander. The book understands evil via a neologism--as sociocide, the murdering of society. In Bosnia, not only were families destroyed, but their homes as well. Not only were bridges, libraries, schools, mosques, and churches demolished, but towns and cities were obliterated. Bosnian Muslims were murdered behind the mindless rhetoric of "ethnic cleansing," and their history and collective memory were viciously attacked. In the first case, the social violence is called "domicide," in the second, "urbicide," and in the third, "genocide." In Bosnia, however, war took on a truly twisted orientation. Not only were social structures and institutions attacked, but society itself became the target. The book develops the significance of sociocide as the consequence of evil in order to understand the suffering and tragedy of people and communities in Bosnia.

The conclusion of the analysis is that international criminal courts recognize most complete defenses in principle. However, they consistently reject them in practice. Is it possible that the soldiers of mass atrocities--Adolph Eichmann in Nazi Germany and Alfredo Astiz in Argentina's Dirty War, for example--act under conditions that prevent them from recognizing their crimes? In the aftermath of catastrophic, state-sponsored mass murder, how are criminal courts to respond to those who either gave or carried out the military orders that seem unequivocally criminal? This important book addresses Hannah Arendt's controversial argument that perpetrators of mass crimes are completely unaware of their wrongdoing, and therefore existing criminal laws do not adequately address these defendants. Mark Osiel applies Arendt's ideas about the kind of people who implement bureaucratized large-scale atrocities to Argentina's Dirty War of the 1970s, and he also delves into the social conditions that could elicit such reprehensible conduct. He focuses on Argentine navy captain Astiz, who led one of the most notorious abduction squads, to discover how he and other junior officers could justify the murders of more than ten thousand suspected "subversives." Osiel concludes that legal stipulations labeling certain deeds as manifestly illegal are indefensible. He calls for a significant change in the laws of war to preserve both justice and the possibility of dialogue between factions in such sharply divided societies as Argentina. Osiel's proposals have profound implications for future prosecutions of Pinochet's lieutenants, Milosevic's henchmen, the willing executioners of Rwanda and East Timor, and other perpetrators of state-endorsed murder and torture.
