Exercising Human Rights investigates why human rights are not universally empowering and why this damages people attempting to exercise rights. It takes a new approach in looking at humans as the subject of human rights rather than the object and exposes the gendered and ethnocentric aspects of violence and human subjectivity in the context of human rights. Using an innovative visual methodology, Redhead shines a new critical light on human rights campaigns in practice. She examines two cases in-depth. First, she shows how Amnesty International depicts women negatively in their 2004 ‘Stop Violence against Women Campaign’, revealing the political implications of how images deny women their agency because violence is gendered. She also analyses the Oka conflict between indigenous people and the Canadian state. She explains how the Canadian state defined the Mohawk people in such a way as to deny their human subjectivity. By looking at how the Mohawk used visual media to communicate their plight beyond state boundaries, she delves into the disjuncture between state sovereignty and human rights. This book is useful for anyone with an interest in human rights campaigns and in the study of political images.

This book examines the ability of citizens across ten European countries to exercise their democratic rights to access their personal data. It presents a socio-legal research project, with the researchers acting as citizens, or data subjects, and using ethnographic data collection methods. The research presented here evidences a myriad of strategies and discourses employed by a range of public and private sector organizations as they obstruct and restrict citizens' attempts to exercise their informational rights. The book also provides an up-to-date legal analysis of legal frameworks across Europe concerning access rights and makes several policy recommendations in the area of informational rights. It provides a unique and unparalleled study of the law in action which uncovered the obstacles that citizens encounter if they try to find out what personal data public and private sector organisations collect and store about them, how they process it, and with whom they share it. These are simple questions to ask, and the right to do so is enshrined in law, but getting answers to these questions was met by a raft of strategies which effectively denied citizens their rights. While Kazakhstan is not a country with frequent or dramatic government crackdowns on freedoms and human rights, when it comes to exercising fundamental rights such as worship, press freedom, and assembly, Kazakhstan's people live in an atmosphere that is far more circumscribed and fearful than one would expect of a country that will soon take on the leadership of an organization grounded in human rights principles. This report documents human rights violations in these three areas. It analyzes overly restrictive measures, and draft laws that fail to correct them. It describes the often subtle but effective methods the government uses to prevent people from fully exercising these rights. Kazakhstan should implement, soon, consistently, and meaningfully the human rights reforms it has promised the OSCE and which are required of it as an OSCE participating state. In so doing, Kazakhstan would provide an important positive example to other countries of Central Asia.

The dilemma of a liberal human rights lawyer is this: one both believes in and doubts human rights. No wonder, for human rights are ambivalent. As positive legal enactments, they are the result of political bargaining that speak the concrete and verifiable language of rules; yet they also hold an intangible promise of universal good that reaches beyond the text of enacted rules, evoking their cosmopolitan purpose. This dual nature makes human rights strong and accounts for their extraordinary appeal. But it also makes the practice of human rights a fundamentally liberal exercise in irresolution. This book offers a critical, albeit sympathetic, exploration of the conditions for practising and enforcing human rights in a world steeped in ambivalence. Through an historical narrative it first unravels the liberal tension that inheres in rights, and then moves on to examine the case law of the European Court of Human Rights to illustrate how the tension compels a choice in the exercise of rights.
