The SSF Guidelines are based on internationally accepted human rights standards and are to be interpreted and implemented in accordance with those standards. Their objectives are to be met through the promotion of a human rights-based approach (HRBA). This approach seeks to ensure the participation of small-scale fishing communities in non-discriminatory, transparent and accountable decision-making processes by putting particular emphasis on the needs of vulnerable and marginalized groups and developing countries. While the HRBA has been recognized by FAO as a principle that informs the design, implementation, monitoring and evaluation of programmes and projects,1 there is still limited experience in its practical application in the context of small-scale fisheries (SSF). It is therefore important to explore how the approach could support the implementation and monitoring of the SSF Guidelines. Accordingly, the workshop on “Exploring the human rights-based approach in the context of the implementation and monitoring of the SSF Guidelines” explored what the human rights-based approach means within the context of small-scale fisheries in general and the thematic areas covered by the SSF Guidelines in particular. It discussed what the HRBA entails in terms of the conduct of the various state and non-state actors to whom the SSF Guidelines are addressed as well as the needs of the different stakeholders in the various policy areas, with a view to developing guidance materials for the application of the HRBA in the implementation and monitoring of the SSF Guidelines.

In June 2014, FAO member-states endorsed the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries (SSF Guidelines). These Guidelines are one of the most significant landmarks for small-scale fisheries around the world. They are comprehensive in terms of topics covered, and progressive, with their foundations based on human rights and other key principles. It can be anticipated that implementing the SSF Guidelines, whether at local, national, or regional levels, will be challenging. This book contains in-depth case studies where authors discuss the extent to which the Guidelines can help improve the realities of small-scale fishing men and women globally and make their livelihoods and communities more secure. This will require policy intervention and innovation, along with contributions of civil society organizations and academia. However, most of all it will necessitate the empowerment of fishing people so that they can become active participants in decision making on matters where their well-being and human rights are at stake. By endorsing the SSF Guidelines, states have committed themselves to support and facilitate this development. This book asks whether states can successfully “walk the talk,” and provides advice as to how they can do so. The collection of case studies sets the platform for an interactive dialogue space for researchers, policy makers, civil society and small-scale fishing communities to start the conversation about the monitoring and evaluation of the implementation of the SSF Guidelines at local, national, regional and global levels. The adoption of Voluntary Guidelines to Support the Progressive Realization of the Right to Adequate Food in the Context of National Food Security (Right to Food Guidelines) in 2004 and the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) in 2014 were two major achievements in the effort to ensure food security and nutrition. This handbook has been developed to support the joint implementation of the SSF Guidelines and the Right to Food Guidelines through an integrated approach and to increase policy coherence and uptake. The document provides an overview of the contents of these voluntary guidelines and identifies potential synergies. It also explains the human rights-based approach and discusses some crucial areas, with special attention to the specific roles and responsibilities of key actors. This document is primarily directed at those involved in the integration of the SSF Guidelines and the Right to Food Guidelines into national policies and development programmes targeting the small-scale fisheries sector in the context of food security and nutrition. The Voluntary Guidelines for Securing Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) are the first international instrument dedicated entirely to the small-scale fisheries sector. While the implementation of the SSF Guidelines will require legal and regulatory adjustments beyond national fisheries legislation to ensure political and legislative coherence and fully reflect the breadth of their provisions, the fundamental function of fisheries law in a sustainable use, management, and the development of small-scale fisheries is indisputable. Appropriate fisheries legislation provides the strongest possible framework for inclusive, participatory fisheries governance and resource management by providing a coherent basis for implementing and enforcing the SSF Guidelines and other related international and regional agreements and commitments. Legislation can therefore be a tangible way to support small-scale fishers, fish workers, and their communities and contribute to broader development goals, including the progressive realization of the right to food, poverty eradication, equitable development, and sustainable resource utilization. Being able to access fish and other aquatic resources in inland waters for nutrition and food security is essential for rural populations in many developing countries and inland fisheries contribute significantly to achieving the Sustainable Development Goals. The Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security, and the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication, are tools allowing governments to strengthen governance and develop policies that secure equitable distribution of benefits and empower stakeholders. This document examines the tenure systems, rights and governance issues in the vast, diverse and complex inland fisheries of India. The objective is to highlight how inland fisheries have been changing and the associated challenges for governance and tenure. The legal and policy contexts, within which fishing in rivers, wetlands and estuaries takes place, are described as well as the diversity of fishing activities and practices in the different environments found in India, which include inland capture fisheries, culture-based fisheries and freshwater aquaculture systems. Multiple drivers of change that affect inland fisheries are discussed from within the fisheries sector and from wider social, economic and environmental contexts. Small-scale fisheries (SSF) play an important role in food security and poverty reduction. However, this role is not always recognized and many SSF communities remain marginalized, both with regard to resource management and from a broader social and economic perspective. The Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the Context of Food Security and Poverty Eradication (SSF Guidelines) are the first international instrument dedicated entirely to the immensely important small-scale fisheries sector. The project “Enhancing the contribution of small-scale fisheries to food security and sustainable livelihoods through better policies, strategies and initiatives” is part of the FAO Umbrella Programme for the promotion and application of the SSF Guidelines. The evaluation of this project provides important lessons and recommendations that will inform the formulation and implementation of related on-going projects under the Umbrella Programme, for enhanced promotion and application of the SSF Guidelines. The evaluation found that the project has succeeded in firmly anchoring SSF considerations in the global fisheries policy and research agendas, and in increasing momentum in regional and national awareness of, and commitment to, the SSF Guidelines. The project has allowed a process of consolidation of the trajectory of change initiated with the adoption of the SSF Guidelines, but more time is needed for benefits to trickle to lower levels of governance and to SSF communities themselves.
