Born in a fishing settlement in the Niger Delta region of Nigeria in West Africa, Amaka, whose mother died in the hands of local midwives a few minutes after her birth, did not enjoy the love of her own mother. At the end her testimony demonstrated the power of God over those who first of all completely yield to Him despite their troubles, and still go ahead to pursue their dreams with a strong determination to make it in the end. Fate smiled at Amaka in the end, but not before life dealt several blows on her in what could best be described as a life of struggle. This book will make an interesting reading for people of all backgrounds, ages and cultures and will particularly be of benefit to students of African History and related courses. Children's rights are now enshrined in the South African constitution, and lip service is regularly paid to them, but how effectively are they implemented? From research undertaken by the Centre for Socio-Legal Research over the last twenty years, the question has increasingly arisen of how much use such rights are on paper if the systems charged with ensuring their implementation are inadequate for the task. Possibly even more important, it has become evident that it is not enough to make 'the best interests of the child' the touch-stone for legal and welfare decisions on children, if the individuals charged with those decisions have little training -- or ready access to expertise -- in child development or the realities of a fast-changing country of many cultures. Decisions that radically affect children's futures -- whether custody decisions on divorce, fostering, children's home, adoption placements, or juvenile court decisions -- have life-long consequences. But there is also little hard evidence of what is influencing such decisions in practice, nor how decision-making for South African children can be improved. This book is the result of an attempt to remedy some of these gaps. It presents the evidence from an interdisciplinary collaborative project set up to research how legal decisions on children are being made in the new South Africa, and how children's rights are faring in practice in a variety of relevant settings.

In modern Latin America, profound social inequalities have persisted despite the promise of equality. Nara B. Milanich argues that social and legal practices surrounding family and kinship have helped produce and sustain these inequalities. Tracing families both elite and plebeian in late-nineteenth- and early-twentieth-century Chile, she focuses on a group largely invisible in Latin American historiography: children. The concept of family constituted a crucial dimension of an individual’s identity and status, but also denoted a privileged set of gendered and generational dependencies that not all people could claim. Children of Fate explores such themes as paternity, illegitimacy, kinship, and child circulation over the course of eighty years of Chile’s modern history to illuminate the ways family practices and ideologies powerfully shaped the lives of individuals as well as broader social structures. Milanich pays particular attention to family law, arguing that liberal legal reforms wrought in the 1850s, which left the paternity of illegitimate children purposely unrecorded, reinforced not only patriarchal power but also hierarchies of class. Through vivid stories culled from judicial and notarial sources and from a cache of documents found in the closet of a Santiago orphanage, she reveals how law and bureaucracy helped create an anonymous underclass bereft of kin entitlements, dependent on the charity of others, and marginalized from public bureaucracies. Milanich also challenges the recent scholarly emphasis on state formation by highlighting the enduring importance of private, informal, and extralegal relations of power within and across households. Children of Fate demonstrates how the study of children can illuminate the social organization of gender and class, liberalism, law, and state power in modern Latin America.
