This book, first published in 2005, develops a comparative model of intergovernmental bargaining to account for variation in the capacity of federations in the developing world to undertake economic policy reform, suggesting that many market reform policies are a function of a constant process of bargaining between national and regional leaders struggling for political survival. As the degree of national-regional disagreement mounts, collective action on reforms that require implementation at multiple levels of government becomes more difficult. The degree to which the two factors conflict depends on four factors: the individual electoral interests, a shared intergovernmental fiscal system, the manner in which regional interests are represented in national policy making and the levers of partisan influence national leaders have over subnational politicians. In testing the argument with a combination of cross-sectional time-series and case study analysis, this book contributes to the broad literatures on development and the comparative political economy of federalism and decentralization.

Federalism is at once a set of institutions -- the division of public authority between two or more constitutionally defined orders of government -- and a set of ideas which underpin such institutions. As an idea, federalism points us to issues such as shared and divided sovereignty, multiple loyalties and identities, and governance through multi-level institutions. Seen in this more complex way, federalism is deeply relevant to a wide range of issues facing contemporary societies. Global forces -- economic and social -- are forcing a rethinking of the role of the central state, with power and authority diffusing both downwards to local and state institutions and upwards to supranational bodies. Economic restructuring is altering relationships within countries, as well as the relationships of countries with each other. At a societal level, the recent growth of ethnic and regional nationalisms -- most dramatically in Eastern Europe and the former Soviet Union, but also in many other countries in western Europe and North America -- is forcing a rethinking of the relationship between state and nation, and of the meaning and content of 'citizenship.' Rethinking Federalism explores the power and relevance of federalism in the contemporary world, and provides a wide-ranging assessment of its strengths, weaknesses, and potential in a variety of contexts. Interdisciplinary in its approach, it brings together leading scholars from law, economics, sociology, and political science, many of whom draw on their own extensive involvement in the public policy process. Among the contributors, each writing with the authority of experience, are Tommaso Padoa-Schioppa and Jacques Pelkmans on the European Union, Paul Chartrand on Aboriginal rights, Samuel Beer on North American federalism, Alan Cairns on identity, and Vsevolod Vasiliev on citizenship after the breakup of the Soviet Union. The themes refracted through these different disciplines and political perspectives include nationalism, minority protection, representation, and economic integration. The message throughout this volume is that federalism is not enough -- rights protection and representation are also of fundamental importance in designing multi-level governments.

Though these countries vary significantly in both their federal institutions and labour market policies, they all seek to define a relatively coherent approach for federal and sub-unit governments in a policy field where collaboration and coordination appear unavoidable. In some cases, such as Germany, collaboration is highly developed and policies are ambitious and integrated; in others, such as Switzerland, diversity and decentralization are privileged and policies remain fragmented. Finally, there are countries such as the United States that do not grant much importance to labour market policies. these five federations and so help us understand how political institutions and public policies are inter-related. Federalism and labour market policies certainly influence each other, but there is no simple relationship between them. Comparing different governance and employment strategies is nevertheless very instructive because it shows the range of approaches and policies that are possible in federal countries.

Protectionism has become less and less of a viable instrument of intervention by national governments, particularly for member-states of common markets. This Hobart Paper provides a formal framework for analysing the effect on domestic policy choices of constraining the power of national governments to maintain trade barriers, as experienced in GATT-type arrangements, in common-market treaties, and in other free-trade agreements within blocs of trading partners. The author argues that the government of a national economy with free inward and outward movement of factors and goods, has little or no power to engage in purely redistributive policies. The member governments of a common market are in a position approximating that of the government of a small economy, free of trade barriers. Federalism and free trade go hand in hand inasmuch as they both strengthen governments' power to do good, while restricting their power to abuse citizens. The paper attempts to show that the opening of national frontiers to freer movement of goods, services, capital, and people will result in less use of other instruments of intervention in domestic affairs. Less reliance on protectionism by national governments will have an impact similar to reinforcing devolution of power within federal states. Imposing heavier taxes and restrictive regulations on national resources in conditions of free trade leads first to more rapid and more pronounced substitution of foreign for local production. It also causes capital to move out of higher-cost economies. Finally, victims of government abuse may 'vote with their feet' and leave the territory. Freer trade is a first step and a sufficient condition towards the federalisation of the world. However, this competitive federalist model only works if national and local decisions are not superseded by vast central powers covering the same fields within trade blocs or at the supra-national level. As a tool for cartelising national and regional governments, centralisation weakens the ability of citizens to escape unpopular measures by moving their goods or their production factors to more favourable locations and uses.

Federalism is about dividing and sharing government, often in complex ways that involve some tasks being done jointly. Are federal systems capable of effective joint policy-making? Is this possible in the fast-moving context of globalization? In Market Rules Douglas Brown examines these questions through a comparative study of Australia and Canada, looking at recent major reforms to the economic union in the two federations and comparing them with the evolving European Union (EU). Brown argues that internal barriers to trade and competition in these countries were significant obstacles to competition in the global economy and shows that the old market rules were rooted in longstanding political and regional compromises. He describes the process of detailed and difficult intergovernmental collaboration required for the EU, and now Canada and Australia, to produce new market rules. The resulting reforms created new regimes that provide deeper and broader national economic integration in Canada and Australia than in the EU.
