The observation that mater semper certa est remains accurate under most legal systems in the world. Maternity is defined as the personal status (filiation) of a woman who gave birth to a child. It is typically complemented by the fatherhood of the man from whom the child biologically originates (often quem nuptiae demonstrant). However, in some states, a kind of competitive way of acquiring the legal status of mother and father (or “homosexual parents A and B”) has been introduced via concluding a contract with a surrogate mother. Usually with a woman coming from poorer societies and with the assistance of professional intermediaries and organizers. The postulates to change substantive family law, or at least to recognize the effects of foreign law and procedures (a kind of “procreative tourism”), appear nowadays also in states generally prohibiting surrogate motherhood. The issues discussed in this volume concern both national law and international court cases. Recent examples include the opinion of the European Court of Human Rights of 10 April 2019 initiated by the French Cour de cassation, the judgement of the German Bundesgerichtshofof 20 March 2019, and dilemmas of Polish administrative courts. Focusing on the international perspective, the present volume as well as an accompanying book in Polish are the results of the international cooperation of over 30 experts from both member states and observer states of the Council of Europe. The monograph is structured “from the general to the detail” and includes a comprehensive view as well: from the issues of philosophy and sociology of law, to human rights standards of national constitutions and international agreements, to principles of ordre public of forum and their protection with measures of private, public, and penal law. This allows readers, including legislators and judges, the better understanding of the fundamental legal problems that surrogate motherhood brings, both in states where law creates them in a narrower or wider extent, and in other countries of the world, to which these problems can be imported with the movement of people and with de lege lata and de lege ferenda postulates.

Jednakże w niektórych państwach konkurencyjnym sposobem nabycia stanu cywilnego matki lub ojca (albo „rodziców homoseksualnych A i B”) stała się umowa zawierana z surrogate mother, najczęściej z kobietą z biedniejszych społeczności oraz z udziałem zawodowych pośredników i organizatorów. Postulat wprowadzenia podobnego rozwiązania w krajowym prawie rodzinnym, bądź chociaż uznawania materialnych skutków zagranicznych procedur (swego rodzaju „turystyki prokreacyjnej”), bywa zgłaszany też w państwach generalnie zakazujących surrogate motherhood. Wiele dyskutowanych zagadnień jest przedmiotem postępowań przed sądami krajowymi i międzynarodowymi. Ostatnimi przykładami są opinia Europejskiego Trybunału Praw Człowieka z 10 IV 2019 r., wydana na wniosek francuskiego Cour de cassation, orzeczenie niemieckiego Bundesgerichtshofz 20 III 2019 r. oraz rozterki polskich sądów administracyjnych. Książka, jak też uzupełniająca publikacja w języku angielskim z szerszym ujęciem zagadnień globalnych, są rezultatem międzynarodowej współpracy ponad 30 ekspertów z państw członkowskich lub obserwatorów Rady Europy. Monograficzne przedstawienie problematyki zostało przygotowane „od ogółu do szczegółu” i kompleksowo: od zagadnień filozofii i socjologii prawa, przez standardy praw człowieka z krajowych konstytucji i międzynarodowych paktów, po podstawowe zasady ordre public i ich ochronę drogą rozwiązań prywatnoprawnych i publicznoprawnych, w tym penalnych. Pozwala to czytelnikom, w tym legislatorom i sędziom, lepiej zrozumieć fundamentalne problemy prawne związane z surrogate motherhood zarówno w państwach, których przepisy prawa krajowego je kreują, jak i w pozostałych państwach świata, do których problemy te mogą przenikać wraz z ruchem osobowym oraz postulatami de lege latai de lege ferenda.

In The Metamorphoses of Kinship, the world-renowned anthropologist Maurice Godelier contextualizes these developments, surveying the accumulated experience of humanity with regard to such phenomena as the organization of lines of descent, sexuality and sexual prohibitions. In parallel, Godelier studies the evolution of Western conjugal and familial traditions from their roots in the nineteenth century to the present. The conclusion he draws is that it is never the case that a man and a woman are sufficient on their own to raise a child, and nowhere are relations of kinship or the family the keystone of society. Godelier argues that the changes of the last thirty years do not herald the disappearance or death agony of kinship, but rather its remarkable metamorphosis—one that, ironically, is bringing us closer to the “traditional” societies studied by ethnologists.

Interest in the study of kinship, a key area of anthropological enquiry, has recently reemerged. Dubbed 'the new kinship', this interest was stimulated by the 'new genetics' and revived interest in kinship and family patterns. This volume investigates the impact of biotechnology on contemporary understandings of kinship, of family and 'belonging' in a variety of European settings and reveals similarities and differences in how kinship is conceived. What constitutes kinship for different publics? How significant are biogenetic links? What does family resemblance tell us? Why is genetically modified food an issue?
