El análisis conceptual, normativo y comparativo sobre la dignidad humana dentro del derecho no es algo muy frecuente, a pesar de que su protección y promoción se reclamen cada vez más en la práctica. La indefinición trae incoherencia y aplicaciones incorrectas de una expresión tan poderosa dentro del lenguaje jurídico. En esta obra no se le niega carácter jurídico-normativo a la dignidad humana, ni tampoco se defienden posiciones absolutistas en las que se le tome como el valor que funda todo sistema jurídico o que impone un perfeccionismo al sujeto, o en las cuales este determine de forma soberana el deber ser a partir del sentimiento de indignidad. Tras explorarse su contexto moral, cultural y lingüístico, se sostiene que la dignidad humana tiene un sentido conceptual y normativo constante que le permite ser objeto de una norma jurídica de derecho fundamental objetivo, dotada de especificidad. Con ella se pretende garantizar el igual respeto y consideración hacia la persona humana por medio de protecciones negativas y positivas frente al riesgo de tratos crueles, inhumanos o degradantes, de avasallamiento e instrumentalización, o de exterminio y exclusión. Esta norma se desarrolla de manera gradual, partiendo del derecho convencional y constitucional, pero su alcance y significados normativos concretos interpelan a las demás disciplinas jurídicas.
