This report deals with the Biological Assessment, Biological Opinion and Final Report on the construction of a high- efficiency 34-meter, multifrequency beam-waveguide antenna at the Apollo Site of the Goldstone Deep Space Communications Complex, operated by JPL. According to the Endangered Species Act of 1973, a Biological Assessment must be conducted and a Biological Opinion, with terms and conditions, rendered (the Opinion by the U.S. Department of the Interior) before construction of any federal project that may affect endangered or threatened flora or fauna. After construction, a final report is filed with the Department. The desert tortoise, designated "threatened" by the U.S. Fish and Wildlife Service, and the Mojave ground squirrel and the Lane Mountain milk vetch, both designated "candidate threatened," required the reporting specified by the Act. The Assessment found no significant danger to the animal species if workers are educated about them. No stands of the plant species were observed in the surveyed construction area. The Department issued a Biological Opinion to safeguard the two animal species. The Service and the California Department of Fish and Game both issued a Biological Concurrence that JPL had satisfied all environmental criteria for preserving threatened species. The Environmental Protection Agency (EPA) is proposing to implement remedial actions at the Marathon Battery Co. Site (MBCS) in Cold Spring, New York, pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act, as amended by the Superfund Amendments and Reauthorization Act (CERCLA/SARA). The shortnose sturgeon (Acipenser brevirostrum), a federally-listed endangered species, is known to occur in the Hudson River in the vicinity of the site. Portions of the proposed remedial actions will take place in aquatic habitats of, and associated with, the Hudson River. Accordingly, as part of its efforts to comply with the requirements of the Endangered Species Act (ESA), EPA has prepared a Biological Assessment (BA) of the potential impacts of the proposed remedial actions on the shortnose sturgeon.

During 2001, a severe drought occurred in the Klamath River Basin. The U.S. Department of the Interior (DOI) determined that the newly issued biological opinions and their RPAs must prevail; thus, water that would have gone to irrigators was directed almost entirely to attempts to maintain minimum lake levels and minimum flows as prescribed in the two RPAs. The severe economic consequences of this change in water management led DOI to request that the National Research Council (NRC) independently review the scientific and technical validity of the government's biological opinions and their RPAs. The NRC Committee on Endangered and Threatened Fishes in the Klamath River Basin was formed in response to this request. The committee was charged with filing an interim report after approximately less than 3 months of study and a final report after about 18 months of study. The interim report, which is summarized here, focuses on the biological assessments of the USBR (2001) and the USFWS and NMFS biological opinions of 2001 regarding the effects of Klamath Project operations on the three listed fish species.
