"This final action will modify the permitting and retention requirements for Atlantic HMS to address the incidental catch of North Atlantic swordfish in the Illex squid trawl fishery, and the incidental catch of species in the smoothhound shark complex (genus Mustelus) in all Atlantic trawl fisheries. The action will reduce regulatory dead discards of incidentally caught swordfish in the Illex squid trawl fishery by establishing a new Incidental HMS Squid Trawl permit. It will also establish a retention limit for smoothhound sharks in all Atlantic trawl fisheries. This action would modify the groundfish retention standard (GRS) program by removing certain regulatory requirements mandating minimum levels of groundfish retention and adding requirements for annual reports on groundfish retention performance. The GRS program was implemented to increase the retention and utilization of groundfish caught by trawl catcher/processor (C/P) vessels not listed in the American Fisheries Act (AFA), referred to as Amendment 80 vessels, and Amendment 80 cooperatives participating in the Bering Sea and Aleutian Islands groundfish fisheries. NMFS has discovered that the regulatory methodology used to calculate compliance with the GRS requires individual Amendment 80 vessels and Amendment 80 cooperatives to retain groundfish at minimum rates well above the minimum rates recommended by the Council or implemented by NMFS. This action would relieve non-AFA trawl C/Ps and Amendment 80 cooperatives from undue compliance costs stemming from the mandatory GRS rates.

"This regulatory amendment would increase the 2011 TAC from the existing 5.68 million pounds (MP) to 6.68 MP, set TACs through 2015, and increase the red grouper bag limit from two to four fish. A rerun of the stock assessment including new information and lower than projected 2010 landings showed an improved condition of the stock and supported an increase in the 2011 and subsequent TACs. These increases are consistent with the goals and objectives of the Gulf of Mexico Fishery Management Council 's FMP for the management of this species. Resultant rulemaking would increase the 2011-2015 commercial quotas, and because red grouper are a part of the shallow-water grouper (SWG) quota, also set the 20 11-2015 SWG quotas. The amendment and subsequent rulemaking would also increase the red grouper bag limit from two to four fish to allow the recreational sector to harvest their allocation of the TAC.
