English summary: The institutional structure of financial services supervision has been the subject of intensive discussion, at least since the financial crisis from 2007 to 2009. Alongside the EU debt crisis, the advance of globalization and the increasing consolidation of financial markets are creating unprecedented challenges for the Member States of the European Union and for the Union itself. Nadine Ruppel analyzes the strengths and weaknesses of the existing supervisory system in the EU by critically assessing legislation and law enforcement in terms of legal and political effectiveness and efficiency. Against this background, she suggests options for the future development of financial services supervision. Taking into account the existing economic, political and legal (in terms of European constitutional law) requirements, she assesses and evaluates the feasibility of various supervisory systems and structures. German description: Die institutionellen Ausgestaltung der Finanzdienstleistungsaufsicht auf EU-Ebene ist spatestens seit der Finanzkrise 2007 bis 2009 Gegenstand intensiver Diskussionen. Neben der EU-Schuldenkrise stellen die fortschreitende Globalisierung und die zunehmende Integration der Finanzmarkte die Mitgliedstaaten der Europaischen Union und die Union selbst vor ungeahnte Herausforderungen. Nadine Ruppel analysiert zunachst die Starken und Schwachen des existierenden Aufsichtssystems in der EU, indem Rechtsetzung und Rechtsdurchsetzung aus den Perspektiven der rechtlichen und politischen Effektivitat und Effizienz einer kritischen Wurdigung unterzogen werden. Vor diesem Hintergrund zeigt sie Wege fur eine Weiterentwicklung der Finanzdienstleistungsaufsicht auf. Die Realisierbarkeit verschiedener Aufsichtssysteme und -strukturen wird unter Berucksichtigung okonomischer, politischer und (europaverfassungs-)rechtlicher Rahmenbedingungen eingeschatzt und bewertet.

Dieses Thema ist einerseits dadurch interessant, dass die politische Regulierung im Politikfeld Finanzmarkt durch die Globalisierung beschleunigt wurde und spätestens durch die Subprime-Finanzkrise 2008 in den Fokus der Öffentlichkeit gerückt ist. Andererseits ist die Aktualität der Ratifizierung für mich ein Grund, mich diesem Thema zu widmen. Zuletzt nimmt die Versicherungsbranche eine fundamentale Rolle in der deutschen Volkswirtschaft ein und agiert durch ihre Produkte als Scharnier zwischen Volks- und Finanzwirtschaft. Daher gilt es, die politische Regulierung der Versicherungsbranche genau zu betrachten. Am 01. Januar 2016 trat die Richtlinie „Solvency II“ der Europäischen Union in Kraft. Mit neuen Vorschriften hinsichtlich der Kapitalhinterlegung, der Führung von Versicherungsunternehmen sowie der Berichterstattung an Aufsichtsbehörden wirkt sich diese regulative Direktive erheblich auf die europäische Versicherungswirtschaft aus. Somit wurde die Regulierung einer der größten Branchen Deutschlands im Zuge der Finanzkrise einer erheblichen Regulierung ausgesetzt. Die Arbeit schließt mit einem Ausblick der nationalen wie internationalen Versicherungsregulatorik ab.

This collection offers a comparative overview of how financial regulations have evolved in various European countries since the introduction of the single European market in 1986. Power shifts happened several times throughout history, but they do not occur frequently and are often connected with the use of force. Presently, there is a power shift from the western industrialized states, e.g., from member states of the European Union (EU), to Asian states, in particular China. However, in spite of this growth, it is disputed to what extent the rise of these economies already transcended into power and how it will develop in the future. What is clear by now is that the recent global financial and economic crisis was the worst one in post World War II history. The crisis emerged in the United States and then spread to the EU and to other countries. It led to quickly rising public debt levels in western industrialized states. During this time, states like China or India extended their participation within global economic governance foras, such as the International Monetary Fund (IMF) or the G20. This raises the question of how the power of the European Union within these international institutions was affected by the crisis? The purpose of this publication is to research this question. Consequently, the examination is situated within the domain of the global financial and economic crisis, the shift of power and the power of the EU in international institutions. In order to give an answer to the above stated question, the power shift in international institutions during the time of crisis is to be assessed. The IMF and the G20 are analyzed in depth in order to shed light on the topic. The results then help to identify the trend of EU power.
