In September 1951, Japan signed a peace treaty with forty-eight countries in San Francisco; in April 1952, the treaty came into effect. The San Francisco Peace Treaty is an international agreement that in significant ways shaped the post–World War II international order in the Asia-Pacific. With its associated security arrangements, it laid the foundation for the regional structure of Cold War confrontation: the "San Francisco System" fully reflected the strategic interests and policy priorities of the peace conference’s host nation, the United States. The treaty fell far short of settling outstanding issues in the wake of the Pacific War or facilitating a clean start for the "post-war" period. Rather, critical aspects of the settlement were left equivocal, and continue to have significant and worrisome implications for regional international relations. This book examines the key developments of the contentious political and security issues in the Asia-Pacific that share a common foundation in the post-war disposition of Japan, particularly the San Francisco Peace Treaty. These include both tangible and intangible issues, such as disputes over territories and "history" problems. Taking the San Francisco System as its conceptual grounding, the authors examine how these issues developed and have remained contentious long after the San Francisco arrangements. To provide bases for producing solutions, the chapters offer comprehensive accounts that explain and deepen our understanding of these complex regional issues and the San Francisco System as a whole. Planned, instituted and run by the Japanese Imperial Military during the Asia-Pacific War, the ‘comfort women’ system remains hugely controversial. Although political leaders often contest the role of coercion, many argue that the ‘comfort women’ were mobilized forcibly, through processes of abduction and deception. Utilising archival research, court testimonies and eyewitness accounts of both survivors and military and civilian personnel, this book argues its case in three ways. Part I analyses the modalities of coercion employed by the authorities and investigates the historical differences and continuities between licensed peacetime prostitution and wartime sexual slavery. This book examines laws and customs of war prohibiting rape crimes dating back thousands of years, even though gender-specific crimes, particularly sex crimes, have been prevalent in wartime for centuries. It surveys the historical treatment of women in wartime, and argues that all the various forms of gender-specific crimes must be prosecuted and punished. It reviews the Nuremberg and Tokyo War Crimes Tribunals from a gendered perspective, and discusses how crimes against women could have been prosecuted in these tribunals and suggests explanations as to why they were neglected. It addresses the status of women in domestic and international law during the past one hundred years, including the years preceding World War II and in the aftermath of this war, and in the years immediately preceding the Yugoslav conflict. The evolution of the status and participation of women in international human rights and international humanitarian law is analyzed, including the impact domestic law and practice has had on international law and practice. Finally, this book reviews gender-specific crimes in the Yugoslav conflict, and presents arguments as to how various gender-specific crimes (including rape, forced prostitution, forced impregnation, forced maternity, forced sterilization, genocidal rape, and sexual mutilation) can be, and why they must be, prosecuted under Articles 2-5 of the Yugoslav Statute (i.e., as grave breaches of the Geneva Conventions, torture, violations of the laws of war, violations of the customs of war, genocide, and crimes against humanity). The author, a human rights attorney, academic, and activist, spent three years researching both the treatment of women during periods of armed conflict and humanitarian laws protecting women from war crimes.

This book examines the redress movement for the victims of Japanese military sexual slavery in South Korea, Japan, and the U.S. comprehensively. The Japanese military forcefully mobilized about 80,000-200,000 Asian women to Japanese military brothels and forced them into sexual slavery during the Asian-Pacific War (1932-1945). Korean "comfort women" are believed to have been the largest group because of Korea’s colonial status. The redress movement for the victims started in South Korea in the late 1980s. The emergence of Korean "comfort women" to society to tell the truth beginning in 1991 and the discovery of Japanese historical documents, proving the responsibility of the Japanese military for establishing and operating military brothels by a Japanese historian in 1992 accelerated the redress movement for the victims. The movement has received strong support from UN human rights bodies, the U.S. and other Western countries. It has also greatly contributed to raising people’s consciousness of sexual violence against women at war. However, the Japanese government has not made a sincere apology and compensation to the victims to bring justice to the victims.
