Maka konstitusi menciptakan format, mekanisme kerja dan pola hubungan antar lembaga negara yang dari sisi asas hukum tata negara adanya saling mengawasi dan mengimbangi antar lembaga negara atau check and balances. Bangunan ketatanegaraan yang dibentuk oleh konstitusi selama ini yang dinamai dengan trias politica atau tiga poros besar kekuasaan masih menyisakan masalah ketatanegaraan yang besar dan mendasar. Sebutlah misalnya keberadaan MPR yang oleh undang-undang di institusionalisasikan, kemudian dilengkapi dengan jabatan struktural yang berbeda dengan pimpinan DPR ataupun DPD. Pada jabatan tersebut difasilitasi pula dengan gaji dan hak protokoler yang dibedakan dengan posisi mereka di DPR ataupun DPD. Selanjutnya terkait dengan komposisi jabatan hakim konstitusi yang sarat nuansa politis sebab model pengisiannya diusulkan oleh dua lembaga politik sekaligus (DPR dan Presiden) dan oleh MA. Padahal jika kita bicara tentang independensi hakim salah satu indikatornya pengisian jabatan hakim konstitusi haruslah terbebas dari kepentingan politis. Mengingat posisi Mahkamah Konstitusi dalam menjalankan kewenangannya semisal pengujian undang-undang maupun menyelesaikan sengketa hasil pemilihan umum menjadikannya kapan saja dan setiap saat harus berhadapan secara diametral dan emosional dengan DPR dan Presiden selaku pembentuk undang-undang sehingga sangat rentan intervensi politis. Oleh karena itu tidak dapat tidak pengisian jabatan hakim konstitusi harus bersih dari kepentingan partai politik. Akan lebih baik model pengisian jabatan hakim konstitusi tersebut diserahkan pada Komisi Yudisial sebagaimana halnya dengan pengisian jabatan hakim agung. Demikian pula dalam konteks pemilihan umum misalnya, keberadaan dan pengisian jabatan di lembaga negara seperti Badan Pengawas Pemilihan Umum (Bawaslu) dan Dewan Kehormatan Penyelenggara Pemilihan Umum (DKPP) juga sarat nuansa politis padahal undang-undang disatu sisi meletakkan kedua lembaga tersebut dalam fungsi quasi yudisial, porsi quasi yudisial lebih besar bahkan menjalankan kekuasaan kehakiman atau yudikatif mutlak yang mengurusi terkait penegakan etik seperti DKPP. Sementara itu undang-undang justru mendefenisikan Bawaslu dan DKPP sebagai penyelenggara pemilihan umum kendatipun bertentangan dengan tugas dan kewenangannya yang tidak sekalipun menyelenggarakan pemilihan umum. Disamping itu wacana amandemen konstitusi terus bergulir mesti menjadi perhatian yang penting.
