This is the first descriptive analysis of how American Indian policies are made both at the statewide and at agency levels. Pertinent to all states, the study describes New York's historic policies and emphasizes that improving Indian lifestyles or attracting Indians to government employment is handicapped by their overall distrust of state intentions, a distrust caused by the continued impasse on American Indian land claims. Employing archival records never before used, as well as a plethora of interviews with state officials and American Indians over a fifteen-year period, Hauptman concludes that critical policy changes are needed to build lasting trust.

In the “tribal moment in American politics,” which occurred from the 1950s to the mid- to late-1970s, American Indians waged civil disobedience for tribal self-determination and fought from within the U.S. legal and political systems. The U.S. government responded characteristically, overall wielding its authority in incremental, frequently double-edged ways that simultaneously opened and restricted tribal options. The actions of Native Americans and public officials brought about a new era of tribal-American relations in which tribal sovereignty has become a central issue, underpinning self-determination, and involving the tribes, states, and federal government in intergovernmental cooperative activities as well as jurisdictional skirmishes. American Indian tribes struggle still with the impacts of a capitalist economy on their traditional ways of life. Most rely heavily on federal support. Yet they have also called on tribal sovereignty to protect themselves. Asking how and why the United States is willing to accept tribal sovereignty, this book examines the development of the “order” of Indian affairs. Beginning with the nation’s founding, it brings to light the hidden assumptions in that order. It examines the underlying deep contradictions that have existed in the relationship between the United States and the tribes as the order has evolved, up to and into the “tribal moment.”

The period between the American Revolution and the middle nineteenth century dramatically changed New York State and the Iroquois. Upstate metropolises—Utica, Syracuse, Rochester, and Buffalo—were founded and soon witnessed a phenomenal growth, making New York State one of the fastest-growing regions in the country. This development led to the displacement of the Iroquois. Initially, state officials attempted to force the Indians west. In his book, Laurence M. Hauptman shows how state transportation interests, land speculating companies, and national defense policies worked to undermine the Iroquois. When forced removal of the Indians failed, Albany officials pushed for jurisdiction over the Indians, including attempts to tax them. Hauptman goes beyond simply recounting the tragedy that befell the Indians in New York. Contemporary scholarship and Indian oral tradition come together in this unique account of the history and culture of the Oneida Iroquois—particularly the Wisconsin Oneidas—who have not been the subject of the intense scholarly attention accorded other Iroquois groups. Contributors include Oneida educators, community leaders, historians, anthropologists, and linguists; essays vary from accounts of personal experience and oral history to presentations of academic research. The common denominator is the Oneida experience of cultural change and survival. Part I focuses on the history and adaptations of the Oneidas in their New York homeland. Part II describes the motives and methods used by New York State officials in divesting the Oneidas of their New York home and explores the aftereffects of the Indians' removal to Wisconsin and the legal implications of allotment legislation on American Indians' tribal jurisdiction today. Nineteenth-century attempts by whites to take the Oneidas' Wisconsin land base forced the Indians to develop strategies for survival, described in Part III. Capable leadership, the maintenance of tribal tradition, cultural revitalization, new educational initiatives, and continuing connections among the Oneida communities have fostered a tribal reemergence and have allowed the Oneidas to maintain themselves as a unique and thriving people.
