An unprecedented number of people is currently on the move seeking refuge in Europe. Large parts of European societies respond with anxiety and mistrust to the influx of people. Nationalist, anti-migrant parties from Slovakia over Germany to the UK have gained increasing support among the electorate and challenge the political mainstream. Europe is struggling how to respond. While the search for solutions is ongoing one pattern seems to be emerging: Fortress Europe is in the making. Unfortunately, few of these discussions and measures consider the structural root causes and dynamics of migration, the motives of migrants or societal challenges more thoroughly. This book seeks to address this deficit. Taking migration and asylum policies as a starting point, it analyses the various dimensions underpinning migration. In doing so, it identifies why receiving countries are in many ways part of the problem. To eschew an overtly Euro-centric perspective and stimulate a debate between science and politics, it contains contributions by academics and practitioners alike from both shores of the Mediterranean.

The concept of vulnerability has not been unequivocally interpreted either in regional or in universal international legal instruments. This book analyses the work of the EU and the Council of Europe in ascertaining a clear framework or a set of criteria suitable to determine those who should be considered vulnerable and disadvantaged. It also explores the measures required to protect their human rights. Key questions can be answered by analysing the different methods used to determine the levels of protection offered by the two European systems. These questions include whether the Convention and the case law of the Strasbourg Court, the monitoring mechanisms of the Council of Europe, EU law and the case law of the European Court of Justice enhance the protection of vulnerable groups and expand the protection of their rights, or, alternatively, whether they are mainly used to fill in relatively minor gaps or occasional lapses in national rights guarantees. The analysis also shows the extent to which these two European systems provide analogous, or indeed divergent, standards and how any such divergence might be problematic in light of the EU accession to the European Convention on Human Rights.

This edited volume examines the continued viability of international human rights law in the context of growing transnational law enforcement. With states increasingly making use of global governance modes, core exercises of public authority such as migration control, surveillance, detention and policing, are increasingly conducted extraterritorially, outsourced to foreign governments or delegated to non-state actors. New forms of cooperation raise difficult questions about divided, shared and joint responsibility under international human rights law. At the same time, some governments engage in transnational law enforcement exactly to avoid such responsibilities, creatively seeking to navigate the complex, overlapping and sometimes unclear bodies of international law. As such, this volume argues that this area represents a particular dark side of globalisation, requiring both scholars and practitioners to revisit basic assumptions and legal strategies. The present volume highlights the new challenges of the international protection of refugees fifty years after the adoption of the 1951 Geneva Convention relating to the Status of Refugees. Focusing on the problems faced by Switzerland in the field of international protection of refugees as well as on the specificity of its asylum law and practice, this publication addresses the refugee problem from a national, European and international perspective. The Swiss experience serves to illustrate the wider problematic of on the one hand, the tensions between security, political and humanitarian concerns encountered by refugee-receiving states, and on the other, the need to preserve an international refugee protection regime which remains an essential component of international law and relations for so long as political solutions are not brought to the root causes of refugee exodus. This reflection on the international protection of refugees is organized around four main themes. The first examines Switzerland's response in the past to mass influx, in the light of historical case studies and the evolution of Swiss asylum law and practice. The second focuses on the question of access of refugees to asylum territories and refugee status determination procedures within the framework of the 1951 Convention on the Status of Refugees and the current Swiss asylum law. The third centres on the wider protection regime currently being forged in Europe to address a broader category of refugees, including solutions for temporary and subsidiary protection. The final theme revolves around return of refugees, including those under the Dayton and recent Kosovo agreements and covers reintegration of returnees, assistance and long-term development. This work is based on papers presented at a colloquium of the Graduate Institute of the International Studies in Geneva which was organised in collaboration with the Office of the United Nations High Commissioner for Refugees as a contribution to the 50th anniversaries of the UNHCR and the Geneva Convention relating to the Status of Refugees.
