This book explores the debate and politicisation of the Transatlantic Trade and Investment Partnership (TTIP) negotiations in the Spanish, French and British public spheres. It addresses the questions of how and to what extent the national media discourses about TTIP were Europeanised, and how this type ofEuropeanisation contributes to the democratic legitimacy of the EU. The author argues that the politicisation of TTIP should be seen as a symptom of the ‘normal’ politics of a democratic polity, as it enlarges the political arena by embedding European issues into national political debates. As the European Union undergoes a major, self-proclaimed democratic exercise the Conference on the Future of Europe and approaches Treaty change, this volume offers a new model of citizen participation to address Europe's long-standing democracy challenge, and respond to the aftermath of the COVID-19 pandemic. Proposed are a set of democratic innovations, ranging from citizens assemblies to regulatory gaming to citizens initiatives and lobbying, which are complementary, not antagonistic, to existing representative democracy across the European continent. These innovations are emerging bottom-up across the continent and getting traction at local, national and EU level in a new era powered by technology. This book brings together academics as well as practitioners to give a forward-looking, holistic view of the realities of EU citizen participation across the spectrum of participatory opportunities. They all converge in arguing that, after many years of proven experimentation, the EU must institutionalize supranational, participative and deliberative, democratic channels to complement representative democracy and each other, and ultimately improve the effectiveness of EU citizen participation. While this institutional approach will not magically treat the EU democratic malaise, it should make the system more intelligible, accessible, and ultimately responsive to citizen demand without necessarily undertaking Treaty reform. The attempt to harness citizen participation to help address the current EU crisis needs the type of multi-faceted approach presented in this book. One that recognises the potential of existing and new democratic mechanisms, and also, importantly, the links between different instruments of citizen participation to improve the overall quality of EU's democratic system.

How does the dominant understanding(s) of the demo(i)cratic subject in the EU, and of democracy more broadly, shape the EU’s democratic innovations on ‘citizen participation’? What are the politically and normatively preferable alternatives, both in terms of the conceptualisation of the democratic subject in the EU and in the ensuing political practices? The book addresses these questions combining a political theory with a political sociology perspective, contrasting the ‘democracy without politics’ approach of the EU in the context of the Conference on the Future of Europe with that of ongoing transnational activist processes. In doing so, it develops an agonistic alternative to ‘the people(s)’ as the political imaginary of democracy in the EU, which is based on the idea of the ‘decolonial multitude’. This book examines the legitimization of the European Union through the development and rapid rotation of narratives aiming to convey its identity and purpose. This book addresses the role of investment arbitrators within the framework of international investment law, a system that tends by design to prioritise the interests of foreign investors, often at the expense of the economic and social policies of the host states. The theoretical foundations of this volume are doctrinal, and the argument presented is aimed at contributing to the scholarly debate on the reform of the system of investment law. Because of this, the book is particularly focussed on the scholarship and is aimed at an audience already familiar with the system of investment arbitration and its case-law. The author explores both the explicit and implicit duties of arbitrators and critically questions certain critiques of investment law that call for arbitrators to interpret bilateral investment treaties and free trade agreements in ways that also protect the host states’ interests. While the author argues that challenges to the legitimacy and credibility of the current investment law regime are well-founded, he also argues that arbitrators find themselves constrained by the prevailing legal framework, unable to fully balance the competing interests of foreign investors and host states. The book concludes that achieving greater equality in the investment legal regime necessitates a departure from the existing bilateral investment treaties paradigm and calls for a more just and balanced system of investment treaties. The author argues that, until such a transformation occurs, arbitrators remain compelled to apply the current applicable law, highlighting the insurmountable limitations and tensions within the present system.
