English summary: The German Basic Law (Grundgesetz) calls for the regulation and safeguarding of freedom through active legislation. Using its constitutional authority to monitor the fulfillment of this task, the Federal Constitutional Court has to compete increasingly with the legislator's power. By going back to the historic roots of the idea of freedom, Gerd Morgenthaler develops legal criteria for the protection of the parliamentary power to shape the legal system. With the help of these criteria he then analyzes the jurisdiction of the German Federal Constitutional Court. Mit Hilfe der daraus abgeleiteten Massstabe erhalt die Kompetenz des Bundesverfassungerichts, die Legislative bei der freiheitsordnenden und -sichernden Gesetzgebung zu kontrollieren und auch anzuleiten, einen juristisch bestimmbaren Gehalt. Die so entwickelte und nach Staatsfunktionen differenzierende Lehre der Freiheitsgrundrechte erlaubt Gerd Morgenthaler eine fundierte Kritik der gegenwartigen Rechtsprechungspraxis und der geltenden Gesetzeslage anhand konkreter Beispiele.

This book assembles main contributions to an alternative explanation of globalisation and the political economic structures of the international system. As the result of capitalism, globalisation does not transfer basic capitalist structures from the Centre to the Periphery. Capitalism is based on rising mass incomes that create investment opportunities and, thus, the possibility of profit. A structurally homogeneous and ultraimperialist Centre dominates a deeply fissured Periphery of structurally heterogeneous societies and economies. Capitalism penetrates underdeveloped regions and deforms them through rent, which obstructs expanding internal mass markets while labour goes unempowered. Rent constitutes the basis for state operations and the role of emerging state classes. While globalisation disempowers labour in both the West and in the South, it has given new comparative advantage to the South. The shift from rent appropriation in the South via raw material exports to export-led manufacturing is based on devaluation below purchasing power parity and, hence, on a rent from agriculture that is based on the Green Revolution. Its impact is, however, not always sufficient to compensate for the loss of influence experienced by social reformist forces. A novel multipolar system based on the balance power has emerged. Mutliethnic empires are held together with large varieties of however always identitarian ideologies. This global system is composed of powers that are internally and externally opposed to peaceful change. Across the globe, there is an impending danger of globalisation of rent. Moving book history in a new direction, this study examines publishers as brokers of Central Europe's political public sphere. They created international print markets, translated new texts, launched new journals, supported outspoken authors, and experimented with popular formats. Most of all, they contested censorship with finesse and resolve, thereby undermining the aim of Prussia and Austria to criminalize democratic thought. By packaging dissent through popular media, publishers cultivated broad readerships, promoted political literacy, and refashioned citizenship ideals. As political actors, intellectual midwives, and cultural mediators, publishers speak to a broad range of scholarly interests. Their outsize personalities, their entrepreneurial zeal, and their publishing achievements portray how print markets shaped the political world.The narrow perimeters of political communication in the late-absolutist states of Prussia and Austria curtailed the open market of ideas. The publishing industry contested this information order, working both within and outside legal parameters to create a modern public sphere. Their expansion of print markets, their cat-and-mouse game with censors, and their ingenuity in packaging political commentary sheds light on the production and reception of dissent. Against the backdrop of censorship and police surveillance, the successes and failures of these citizens of print tell us much about nineteenth-century civil society and Central Europe's tortuous pathway to political modernization. Cutting across a range of disciplines, this study will engage social and political historians as well as scholars of publishing, literary criticism, cultural studies, translation, and the public sphere. The history of Central Europe's print markets between Napoleon and the era of unification doubles as a political tale. It sheds important new light on political communication and how publishers exposed German-language readers to the Age of Democratic Revolution.
